Resolution 73-14202 T RESOLUTION NO. 73-14202 A RESOLUTION AUTHORIZING SETTLEMENT OF WORKMEN'S COMPENSATION CLAIM OF RODERICK THOMAS WHEREAS, on May 16, 1972, RODERICK THOMAS , a City of Miami Beach employee, injured his left foot when a steel post fell on it while he was dismantling a boxing ring. The left foot was subsequently re-injured on July 21, 1973, when the employee slipped while alighting from a truck, and WHEREAS, said employee was examined or treated by Drs . Grossman, Miller, and Toth, and WHEREAS, he suffered a permanent partial disability of his left foot, and WHEREAS, Mr. Thomas is no longer employed by the City of Miami Beach, and WHEREAS, the City Attorney has recommended to the City Council that it is in the best interest of the City to enter into a settlement under the provisions of Florida Statutes 440 .20 (10) , as amended, 1967, such settlement to be in the amount of $878.00. $600 .00 of this amount for the permanent partial disability to his left foot and all past, present, and future compensation and medical benefits for both accidents due Mr . Thomas . A reasonable attorney ' s fee of $190. 00. A reasonable physicians bill of $68.00, and $20.00 court reporter ' s costs, and WHEREAS, the Order of the Judge of Industrial Claims approving such settlement stipulation will not be subject to modification or review, and WHEREAS, the City Council deems it to be in the best interest of the City to enter into a final settlement stipulation as herein set forth, NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney be authorized to enter into a final settlement stipulation with RODERICK THOMAS and his attorney, and if said settlement is approved by a Judge of Industrial Claims, the Mayor, City Clerk, Finance Director, and City Attorney be, andthey are hereby authorized and directed to comply with the Order of the Judge approving said. stipulation .
