Resolution 73-14213 RESOLUTION NO. 73-14213
WHEREAS , City Council of the City of Miami Beach,
Florida, heretofore authorized institution of condemnation pro-
ceedings for the acquisition of the fee simple title to the
following parcel of land, to wit:
Lot 5, FLAMINGO BAY SUBDIVISION,
according to the Plat thereof, recorded
in Plat Book 6 , at page 101, of the
Public Records of Dade County, Florida,
together with the personal property and fixtures situate therein,
said property being also known as 4221 Pine Tree Drive, Miami
Beach, Dade County, Florida, and
WHEREAS , pursuant to said resolution, appropriate
condemnation proceedings were instituted in the Dade County
Circuit Court for said purpose, and
WHEREAS, prior to impanelling of a jury, the proposed
offer of settlement was made by the owner of said parcel, by
and through its attorney, as follows :
The sum of Two Hundred and Fifty-Three
Thousand Dollars ($253, 000 . 00) , to be
paid as follows : $230, 000 . 00 to the
Seller of said parcel of land including
,personal property and fixtures situate
therein and thereon, and $23 , 000 . 00
to the Attorneys for Seller;
and
WHEREAS , the proposed transaction is to be closed on
December 31 , 1973, but the owner shall be entitled to possession
of the said property until February 15, 1974 , and
WHEREAS , the City Attorney, City Manager, and Mr. S.
Z . Bennett, the City ' s Real Estate Consultant, have each
recommended to the City Council that the acceptance of said
settlement is financially advantageous to the City and in its
best interests , and
WHEREAS, the City Council of the City of Miami Beach,
Florida, has duly considered said offer of settlement and said
recommendation, and now being fully advised in the premises, it
is , therefore,
RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA, that the said offer of settlement, as hereinabove recom-
mended, be and the same is hereby accepted and the City Attorney
be and he is hereby authorized and directed to take all legal
steps necessary to effectuate and execute said offer of settle-
ment and the proper financial officers of the City be and they
are hereby authorized and directed to make all payments required
by law hereby and hereunder.
