RESOLUTION NO. 73_14216
WHEREAS , the City Council of the City of Miami Beach,
Florida, by its Resolution No . 13775 , passed and adopted
October 4 , 1972 , authorized and directed institution of
condemnation proceedings to acquire the fee simple title of
certain parcels therein described, and
WHEREAS , appropriate legal proceedings were instituted
for said purpose , and
WHEREAS , during the pendency of said suit it has been
found, ascertained and determined that the cost of acquisition
of the following described parcel included in the foregoing
parcels of land, to wit:
Parcel No . Two :
S 1/2 Block 11 , ALTOS DEL MAR SUB NO . 2,
according to the Plat thereof recorded
in Plat Book 4 at page 162 of the
Public Records of Dade County, Florida,
will exceed the benefits to be derived, and
WHEREAS , the parties owning interests in said latter
described parcel of land have agreed to waive, relinquish and
surrender all claims for costs and attorneys fees in the
said condemnation suit , if the City of Miami Beach agrees to the
dismissal of said parcel of land from the pending condemnation
proceedings , and
WHEREAS , S . Z . Bennett, the City' s Real Estate Con-
sultant, the City Manager and the City Attorney have recommended
to the City Council that such offer be accepted, and
WHEREAS , the City Council of the City of Miami Beach,
Florida, has found and determined that the best interests of the
City of Miami Beach require the acceptance of said offer and said
recommendations ;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney be
and he is hereby authorized and directed to dismiss said parcel
of land, to wit:
S 1/2 Block 11 , ALTOS DEL MAR SUB NO . 2,
according to the Plat thereof recorded
in Plat Book 4 at page 162 of the
Public Records of Dade County, Florida,
otherwise known as Parcel No. Two in said condemnation proceedings ,
upon the conditions and proviso that the parties in interest in
said property execute and deliver to the City of Miami Beach an
approved Stipulation approved by the City Attorney whereby said
parties in interest waive, surrender and relinquish all claims
for costs and attorneys fees for said parcel of land in said
condemnation proceedings .

1973 .
