A RESOLUTION TO CONVEY A WARRANTY DEED
FOR CERTAIN ALTON ROAD PROPERTY TO THE
MIAMI BEACH HOUSING AUTHORITY FOR
CONSTRUCTION OF LOW RENT HOUSING PROJECT
WHEREAS , at the special election held in the City
of Miami Beach on April 23, 1970 , the Electorate of the City
of Miami Beach approved the conveyance of
Lots 15 through 20 , Block 111, OCEAN BEACH
ADDITION NO. 3 , Plat Book 2 , page 81, of
the Public Records of Dade County, Florida.
to the Miami Beach Housing Authority for use as Low Rent
Housing for the Elderly, under Turnkey Contractual Procedures,
either at a nominal consideration or at the value of the said
land as approved by the Department of Housing and Urban Devel-
opment, and

WHEREAS , the City Council of the City of Miami Beach
deems it to be in the best interests of the City, its residents
and taxpayers , that the City of Miami Beach waive the One
Hundred Thousand Dollars ($100, 000. 00) consideration hereto-
fore imposed, so that the said One Hundred Thousand Dollars
($100 ,000. 00) may be utilized appropriately for the purpose
of meeting the increased construction costs.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH , FLORIDA, that the Mayor
and the City Clerk be and they are hereby authorized and
directed to execute and deliver a Warranty Deed, to be
prepared by the City Attorney, in such time and such place
as shall be requested or required by the Miami Beach Housing
Authority and the official representative of the Department
of Housing and Urban Development.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the said deed of conveyance
shall be in the usual warranty form, or in another form as
may be desired and requested by the Miami Beach Housing
Authority and the Department of Housing and Urban Development,
provided, however, that such deed of conveyance shall be
conveyed in accordance with the opinion of the Third District
Court of Appeal of the State of Florida in Nat Ratner v.
City of Miami Beach, et al. , Case Nos. 73-993 and 73-994 ,
filed December 18 , 1973 , and in accordance with the mandate
of the electors of the City of Miami Beach which, at the
special election hild in the City of Miami Beach on April
23, 1970 , authorized this conveyance to the Miami Beach
Housing Authority for use as Low Rent Housing for the Elderly,
under Turnkey Contractual Procedures .
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that Resolution No. 73-14039
be and the same is hereby rescinded, which resolution required
the Miami Beach Housing Authority to provide to the City of
Miami Beach a promissory note for One Hundred Thousand Dollars
($100 ,000. 00) which would be cancelled at the time of the issuance
of the Certificate of Occupancy.

BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the land hereinabove des-
cribed shall be conveyed to the Miami Beach Housing Authority
at the nominal consideration of Ten Dollars ($10. 00) .
