Resolution 74-14261 s P RESOLUTION NO. 74-14261 WHEREAS , on July 25 , 1973 , one JOHN W. CANADY, a City of Miami Beach employee, injured his right leg, when struck by a motor vehicle, while in the performance of his assigned duties , and WHEREAS, said employee was examined by Dr. Grossman, the City Physician and treated by Dr. Raymond Walker, Jr. , an orthopedic surgeon, all as shown by appropriate medical reports , and WHEREAS , he suffered a permanent partial disability of his body as a whole, and WHEREAS , the City Attorney has found and determined that it is in the best interest of the City to enter into a settlement under the provisions of FSS 440. 20 (10) as amended, 1967 , such settlement to be in the total amount of $1,652. 00 , of which $1,440. 00 shall be deemed compensation for the per- manent partial disability to Claimant's body as a whole and all past, present or future compensation and medical benefits due Mr. Canady and the remainder representing a reasonable attorney ' s fee of $192. 00 and $20. 00 as Court Reporter ' s fee, and WHEREAS , the Order of the Judge of Industrial Claims approving such settlement stipulation will not be subject to modification or review, and WHEREAS , the City Attorney has recommended to the City Council that said offer of settlement be accepted, and WHEREAS , the City Council deems it to be in the best interest of the City to enter into a final settlement stipulation as herein set forth, NOW, THEREFORE , BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF MIAMI BEACH, that the City Attorney be authorized to enter into final settlement stipulation with JOHN W. CANADY and his attorney, and if said settlement is approved by a Judge of Industrial Claims , the appropriate financial officers of the City be, and they are hereby authorized and directed to comply with the Order of the Judge approving said stipulation. PASSED and ADOPTED this 6th day of February , 1974.
