A RESOLUTION AUTHORIZING AND EMPOWERING
THE CITY MANAGER TO APPLY TO STATE
DEPARTMENT OF POLLUTION CONTROL UNDER
SECTION 403. 088 , FLORIDA STATUTES , FOR
PERMIT AUTHORIZING ADDITIONAL CONNECTIONS
AND SEWAGE FLOW.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MIAMI BEACH, FLORIDA, that the City Manager of this City be
and he is hereby authorized and empowered, pursuant to Section
403. 088 , Florida Statutes , the same being the "Good Faith
Amendment" , to apply, for and on behalf of the City of Miami
Beach, to the State Department of Pollution Control for an
appropriate modification of its Temporary Operation Permit to
permit such additional connections and sewage flow from such
additional connections to and sewage flow from its present
sewage disposal facility as may be authorized under said "Good
Faith Amendment" , and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the said City Manager be and
he is hereby further authorized and empowered to do and to
perform, in the name of said City, all acts necessary or
appropriate for the accomplishment of said application herein-
above authorized, and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that in the event of the approval
of said application by the State Department of Pollution Control,
and upon the grant to, and during the exercise by, the City of
Miami Beach of the rights and privileges so granted by the
State Department of Pollution Control that it is the intent and
purpose of the City of Miami Beach that package sewage treatment
plant or septic tanks shall be prohibited in the City of Miami
Beach, and that the State Department of Pollution Control and
Metropolitan Dade County be and they are hereby so advised and
informed.
