A RESOLUTION OF THE KAYOR AND CITY COMXISSION
OF THE CITY OF MIAMI BEACH, FLORIDA AMENDING
RESOLUTION NO. 93-20826 CONCERNING THE
ADVISORY CHARTER REVIEW AND REVISION BOARD, BY
PROVIDING THAT THE BOARD SHALL BE DISSOLVED ON
OR BEFORE NOVEMBER 1, 1995.
WHEREAS, on February 19, 1992 the city commission of the city
of Miami Beach, Florida adopted Resolution No. 92-20458,
establishing a new advisory Charter Review and Revision Board; and
WHEREAS, on April 8, 1992, city of Miami Beach Resolution No.
92-20483 was adopted, amending the above-mentioned Resolution by
providing that at least two of the Board members shall have
expertise in business and finance and shall either reside in or
have their principal place of business in the city of Miami Beach;
and
WHEREAS, on October 8, 1992, city of Miami Beach Resolution
No. 92-20616 was adopted amending the above-mentioned Resolutions
by extending the sunset date of said Board from April 1, 1993 to
November 1, 1993 and by providing for all Board expenses to be
assumed by the city of Miami Beach; and
WHEREAS, on June 30, 1993, city of Miami Beach Resolution No.
93-20826 was adopted amending Resolution No. 92-20616 by providing
that the Board shall be dissolved on or before November 1, 1994,
and by providing that expenses of the Board related to informing
the public of the new proposed Miami Beach city Charter be assumed
by the city of Miami Beach; and

Board, is hereby amended to read as follows:

3. The members of this Board shall begin serving on
April 1, 1992. The Board shall submit its report to the
City Commission on or before November 1, ~~, after
which the Board shall be dissolved.
NOW, THEREFORE, BE XT DULY RESOLVED BY THE MAYOR AND CXTY
COMlUSSXON OF THE CXTY IUAMX BEACH, FLORXDA that paragraph "3" of
city of Miami Beach Resolution No. 93-20826 is hereby amended as
stated above to reflect that the dissolution of the Charter Review
and Revision Board shall be on or before November 1, 1995. All
other matters contained within city Resolution Nos. 92-20458, 92-
20483, 92-20616, and 93-20826 shall remain in full force and
effect.

. A RESOLUTION CONTINUING THE EXISTENCE OF THE CHARTER REVIEW
AND REVISION BOARD FOR ONE YEAR, AND PROVIDING THAT SAID
BOARD SHALL BE DISSOLVED ON OR BEFORE NOVEMBER 1. 1995,
AMENDING RESOLUTION NUMBERS 92-20458, 92-20483, 92-20616,
AND 93-20826.
ADKXNXSTRATXON RECOMMENDATION:
The Administration recommends that the Mayor and city commissioners
adopt the Resolution to continue the existence of the Charter Review
and Revision Board for one year, and to provide that said Board shall
be dissolved on or before November 1. 1995.
BACKGROmm:
The Charter Review and Revision Board and staff worked diligently to
produce a new Charter which was approved by the voters of Miami
Beach. Based on legal advice, the Board specifically chose to wait
for the clarification of a pending Supreme Court opinion before
addressing proposals for alternate ways of electing members of the
City commission. The City is currently in litigation on the issue.
The Board also continues to have a second phase assignment of
performing a comprehensive review of the City's Related Laws, which
will probably require another series of special Election-ballot
questions.
Resolution No. 92-20458, as amended by Resolution Nos. 92-20483, 92-
20616, and 93-20826 provides for the dissolution of the Board on
November 1, 1994.
AlfALYSX8:
The term of the Charter Review and Revision Board ends November 1,
1994, however the Board continues to have a viable purpose and has
proven to be an effective vehicle for soliciting community input
regarding the methods of governance in Miami Beach.
Pursuant to the Municipal Home Rule Powers Act of 1973, many of the
existing provisions in the City's Related Laws became ordinances,
while other provisions may only be amended by referendum.
