'", RESOLUTION NO. 95-21643 A RBSOLUTION OP THE MAYOR AND CITY COMMISSION OP THE CITY OP MIAMI BEACH, PLORIDA, REPEALING RBSOLUTION NO. 93-20875 WHICH BSTABLISHED A TRANSPORTATION AND PARKING COMMITTEE AND CREATING A NEW TRANSPORTATION AND PARKING COMMITTEE I PRESCRIBING THE MEMBERSHIP, THE QUALIPICATIONS OP THE MEMBERS, THE TERMS OP OPPICE, THE ORGANIZATIONS OP THE COMMITTBE, AND ITS DUTIES, PUNCTIONS, POWERS AND RESPONSIBILITIES. o __---m WHEREAS, the Mayor and City f Miami Beach, Florida have determined t Parking Committee is needed to serve(the interests of the City. NOW, THERE PORE , BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OJ' THE CITY OP MIAMI BEACH, PLORIDA, that: 1. The Transportation and Parking Committee is hereby created. The Committee shall consist of twenty (20) members. The Mayor and City commissioners shall each make (1) appointment, with the other members of the Committee to be composed of members from the following community organizations each of which must designate a permanent coordinating representative" 1) City of Miami Beach Administrative Representative; 2) Miami Beach Chamber of Commerce I s Transportation and Parking i \ Committee; 3) Miami Beach Development Corporation; 4) Ocean Drive Association; 5) Washington/Collins Avenue Association; 6) Miami Design Preservation League; 7) North Beach Development Corporation; 8) Mid-Beach Community Association; 9) South pointe Advisory Board; 10) Lincoln Road Partnership Parking Committee; 11) South Beach Transportation Management Association; 12) Miami Beach Convention Center/TOPA (SMG); and 13) Middle Beach Partnership, Inc. 2. The members of the voting Committee shall be permanent residents of or have their principal place of business in the City of Miami Beach and have knowledge of and interest in transportation and parking and their impact on the City of Miami Beach. The members of the Board shall be officially designated by their respective organization, and letters certifying that designation shall be forwarded to the Miami Beach City Clerk. 3. All appointments shall be made for a one (1) year term commencing August 1st and expiring July 31st. Appointments to fill any vacancy on the Committee shall be for the remainder 2 of the unexpired term of office. A member may be removed without cause at any time at the sole discretion of the City Commission by a majority vote of the entire membership of the City Commission. When any member of the Committee fails to attend three (3) regularly scheduled meetings during his/her term of office, without due cause, the Chairman shall certify the same to the City Clerk. Such member shall then be deemed to have been removed and a vacancy created. 4. On an annual basis, the members of the Committee shall elect a Chairman and such other officers as may be deemed necessary or desirable, who shall serve at the will of the Committee. The officers shall be chosen from those members appointed by either the Mayor or a City Commissioner. Ten (10) members shall constitute a quorum of the Committee and shall be necessary in order to take any action. Me~ers shall serve without compensation. Committee meetings or subcommittee meetings of the Committee may be called by the Chairman or by written notice signed by ten (10) members of the Committee. Additionally, the Committee may call a meeting to be conducted at a future date. All meetings are public and shall be conducted in accordance with the "Sunshine Law" of the State 3 , of Florida. 5. The Transportation and Parking Committee shall have the following duties, functions, powers and responsibilities: a) To serve in an advisory capacity to the City Commission and the City Administration of the City of Miami Beach, Florida with respect to matters pertaining to transportation and parking and their impact on the communities of the City of Miami Beach. As such, the City Commission and the City Administration of the City of Miami Beach, Florida shall refer matters of public import pertaining to transportation and parking to the Transportation and Parking Committee prior to their adoption or implementation for consideration and recommendation. The matter shall be considered and sent back to the Commission with a recommendation. b) To formulate and recommend plans and programs for coordination of the activities of governmental and nongovernmental entities pertaining to transportation and parking and their impact on the City of Miami Beach. 4 c) It is the express purpose of this Board to serve as a vehicle for responsible persons to utilize and consult with, in attempting to understand and resolve the concerns of the residents of the City of Miami Beach with regard to transportation and parking issues, and to make recommendations to the City Commission and City Administration regarding such matters. d) To perform such other duties as may from time to time be assigned to it by the City Commission. 6. Resolution No. 93-20875 which established a transportation and parking committee is hereby repealed.
