A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC
HEARING FOR JULY 31, 2002 TO CONSIDER PUBLIC
COMMENT, AS REQUIRED BY ORDINANCE NO. 92-2783,
REGARDING THE VACATION OF APPROXIMATELY 60 SQ.
FEET OF SOUTH LINCOLN LANE, ADJACENT TO THE
COLONY THEATER LOCATED AT 1040 UNCOLN ROAD.
WHEREAS, the City owns the Colony Theater located at 1040 Lincoln Road (Property),
legally described as Lot 12 Block 47 of Lincoln Subdivision, according to the plat thereof, as
recorded in Plat Book 9, Page 69 ofthe Public Records of Miami-Dade County, Florida.; and
WHEREAS, in order to render the Property more viable and to meet the Accessibility and
Building Code requirements, an addition and reconstruction of the theater is required; and
WHEREAS, the Property which was constructed in 1935 is designated as a historic
property located within the Flamingo Park Local Historic District; and
WHEREAS, the Historic Preservation Board after reviewing the proposed re-construction
and addition plans during the Board meeting on July 10, 2001, required the addition of column
pilasters projecting maximum 1 foot from the building, to maintain the historic features of the
Property; and
WHEREAS, to accommodate 4 such pilasters on South Lincoln Lane, a strip of 1 foot by
60 feet of the alley must be vacated: and
WHEREAS, pursuant to City Code Article II, Section 82-37 the Mayor and City
Commission are required to hold a public hearing to consider the aforestated request for vacation.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to
consider the vacation of approximately 1 foot wide strip of South Lincoln Lane to accommodate 4
pilasters maintaining the historic architectural feature of the Colony Theater, is hereby called to
be held before the Mayor and City Commission in their Chambers on the Third Floor of City
Hall, 1700 Convention Center Drive, Miami Beach, Florida on July 31, 200 beginning at
.m. and the City Clerk is hereby authorized and directed to publish appropriate Public Notice of
the said Public Hearing in a newspaper of Miami Beach, at which time and place all interested
parties will be heard.

Item Summary/Recommendation:
The Colony Theater, owned by the City's RDA, is undergoing a major renovation and building addition.
At the Historic Preservation Board meeting of July 10, 2001, the Board required the construction of
projecting column pilasters, to restore the original historic building design. The theater building and its
addition are built up to the limits of the right-of-way providing maximum use of the property. The required
4 column pilasters, will be projecting into South Lincoln Lane a maximum of 1 foot. A vacation of a small
piece of right-of-way is appropriate to enable the construction to proceed. A public hearing is required to
complete this action. The Administration's recommendation is to schedule the public hearing on July 31,
2002.

TO THE COLONY THEATER LOCATED AT 1040 LINCOLN ROAD.
ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
BACKGROUND
The Colony Theater, located on the corner of Lincoln Road and Lenox Avenue was
constructed in 1935, and is designated as a historic property located within the Flamingo
Park Local Historic District.
In early 1999, Miami-Dade County Cultural Affairs Department engaged the Zeidler
Roberts Partnership, Inc., to develop conceptual plans and cost estimates for the
expansion and renovation of the Theater. The plan had a preliminary cost estimate of
$1.5 Million. In September 1999, the City was awarded a $720,000 Miami-Dade County
Cultural Affairs Grant. On July 21, 1999, the City Commission authorized the
Administration to apply to the State of Florida, Division of Cultural Affairs, for a $500,000
Cultural Facilities Grant. The City pledged $1,000,000 in (2-for-1) matching funds, from the
following sources:
Miami-Dade County Cultural Affairs Grant $720,000
City ADA Imp Funds $ 60,000
Loan from Cultural Affairs Council $220,000
On October 6, 1999, the Mayor and City Commission adopted Resolution No. 99-23348,
authorizing the City to execute a Professional Services Agreement with the State of
Florida, Department of Management Services (DMS) for construction management ofthe
Colony Theater. DMS Program provides construction-management-at-risk and provides
municipalities with project management services from the onset of a project, throughout the
design phase, bidding process and construction, resulting in a guaranteed maximum price.
On March 6, 2000, DMS authorized R.J. Heisenbottle (Architect), to proceed with
programming and conceptual/advanced schematic design phases for the expansion and
renovation of the Colony Theater. Design Development was the subject of an extensive
programming phase, with input received from the operator and users of the Colony
Theater, City's Historic Preservation Officer, Property Management and the Planning and
Zoning Department.
On the July 10, 2001 Historic Preservation Board meeting, proposed plans for the
reconstruction of the Colony Theater were submitted. The Board's Order following this
meeting required the construction of column pilasters on all sides of the building to restore
the original building design. Since the building will be built up to the limits of the right-of-
way, the architectural/historic column pilasters will be projecting within the alley a maximum
distance of 1 foot.
As the one foot encroachment is into City right-of-way, a vacation of this piece of right-of-
way is necessary to allow construction to proceed.
ANALYSIS
To comply with Ordinance No. 92-2783 codified into City Code Chapter 82, Article II,
Section 82-37, the City, prior to sale or vacation of city property, shall schedule a public
hearing during a City Commission meeting to consider the request for vacation. The
vacation of this strip of right-of-way shall be to the City, owner of the Theater, for the
specific use of the proposed building features.
The City Commission is required to schedule a public hearing advertised not less than
fifteen days, with notices to the property owners within 375 feet of the site, in order to
obtain citizen input into the proposed vacation.
The City's Redevelopment Agency (RDA) and City Clerk will be handling the noticing and
mailers to property owners by July 14, 2002.
CONCLUSION
The Administration recommends the City Commission set a public hearing for July 31,
2002, to consider this vacation.
