2002-24938 Reso RESOLUTION NO. 2002-24938 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING AN AMENDMENT, UP TO THE AMOUNT OF $422,300, TO THE CONTRACT WITH METCALF & EDDY, INC., FOR THE ENVIRONMENTAL RESTORATION OF THE HAZARDOUS WASTE CONTAMINATION AT BAYSHORE GOLF COURSE MAINTENANCE FACILITY; SAID AMENDMENT FOR THE CONSTRUCTION OF A STORMWATER DRAINAGE SYSTEM, WATER AND SANITARY SEWER SERVICES AND BUILDING FOUNDATION PREPARATION FOR THE BAY SHORE GOLF COURSE MAINTENANCE FACILITY. WHEREAS, the soil and groundwater beneath the Bayshore Golf Course maintenance yard is contaminated with hazardous levels of arsenic, which is the result of the improper discharge of waste agricultural chemicals at the facility; and WHEREAS, the City initiated a series of investigations to determine the full extent of the contamination beneath the maintenance yard and adjacent fairway areas, an assessment of the degree of risk to human health posed by the contaminants, and the development of remedial action plans; and WHEREAS, those investigations were carried out over the past seven years and the results were compiled into a Contamination Assessment Report, a Risk Assessment Report, and a Remedial Action Plan, which were submitted to the Miami-Dade County Department of Environmental Resources Management (DERM) for their review and approval; and WHEREAS, the DERM completed its review of the submitted documents and approved the Remedial Action Plan (RAP) in March 2000; and WHEREAS, the cost for implementation of the RAP was estimated at approximately $185,000, and the Mayor and City Commission appropriated the necessary funds and authorized the award of a contract to Metcalf & Eddy, Inc. on May 10,2000; and WHEREAS, concurrent with the on-going environmental assessment and remediation work, the City initiated plans for the complete renovation of the golf course; and WHEREAS, those renovation plans include the construction of a new golf course maintenance facility within the existing maintenance yard area; and WHEREAS, the soil and groundwater beneath the existing maintenance yard is contaminated with arsenic, which will be "managed in-place" beneath an impervious "cap"; and WHEREAS, those elements of the construction of the new maintenance building, which will involve excavation, could potentially expose the construction workers to hazardous materials, the contractor hired to perform the work will be required to utilize special protective equipment and specially trained employees; and WHEREAS, the City has already contracted with Metcalf & Eddy, Inc. to remediate hazardous wastes within the maintenance yard area; and WHEREAS, significant time and cost savings could be realized by consolidating all of the hazardous material work at the site under one contract, it has been determined to be in the City's best interest to have them complete those elements of the construction of the new maintenance building which will involve excavation, in conjunction with the previously authorized hazardous waste remediation work within the maintenance yard; and WHEREAS, the necessary funds are available from the Gulf Breeze Loan proceeds, previously appropriated for the renovation and environmental remediation of the Bayshore Golf Course. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission of the City of Miami Beach, Florida, approve a contract amendment in the amount of $422,300 to the contract with Metcalf & Eddy, Inc., for the environmental restoration of the hazardous waste contamination at Bayshore Golf Course Maintenance Facility; said amendment for the construction of a stormwater drainage system, water and sanitary sewer services and building foundation preparation for the Bayshore Golf Course maintenance facility. The DERM subsequently approved the Remedial Action Plan, which requires the excavation and removal of the most severely contaminated soil from the former chemical storage and mix/load areas within the maintenance yard at the golf course and the installation of a "cap" over the entire maintenance yard to prevent percolating rainwater from spreading contamination from the moderately contaminated soils that will remain in-place beneath the maintenance yard. Concurrent with the on-going environmental assessment and remediation work, the City initiated plans for the complete renovation of the golf course. Those renovation plans include the construction of a new golf course maintenance facility within the existing maintenance yard area. Those elements of the construction of the new maintenance building, which will involve excavation, will require that the contractor hired to perform the work, utilize special protective equipment and specially trained employees. Since the City has already contracted with Metcalf & Eddy, Inc. to remediate hazardous wastes within the maintenance yard area and because significant time and cost savings could be realized by consolidating all of the hazardous material work at the site under one contract, it has been determined to be in the City's best interest to have them complete those elements of the construction of the new maintenance building which will involve excavation, in conjunction with the previously authorized hazardous waste remediation work within the maintenance yard. The City's Program Manager for Parks and Facilities Construction, URS Corporation, has reviewed the contract amendment and agreed to the appropriateness of the proposed scope of work and the associated costs. The necessary funds are available from the Gulf Breeze Loan proceeds, previously appropriated for the renovation and environmental remediation of the Bayshore Golf Course. ANALYSIS The soil and groundwater beneath the Bayshore Golf Course maintenance yard is contaminated with hazardous levels of arsenic, which is the result of the improper discharge of waste agricultural chemicals at the facility. Upon learning of the situation, the City initiated a series of investigations to determine the full extent ofthe contamination beneath the maintenance yard and adjacent fairway areas, an assessment of the degree of risk to human health posed by the contaminants, and the development of remedial action plans. Those investigations were carried out over the past seven years and the results were compiled into a Contamination Assessment Report, a Risk Assessment Report, and a Remedial Action Plan, which were submitted to the Miami- Dade County Department of Environmental Resources Management (DERM) for their review and approval. In March 2000, the DERM completed its review of the submitted documents and approved the Remedial Action Plan (RAP). The approved RAP requires the excavation and removal of the most severely contaminated soil from the former chemical storage and mix/load areas within the maintenance yard at the golf course. Once the severely contaminated soils have been replaced with clean fill material, the City is required to "cap" the entire surface of the maintenance yard with a layer of asphalt. The purpose of the asphalt is to prevent rain water from percolating through the moderately contaminated soils that will \ remain in-place beneath the maintenance yard. (Percolating rainwater could "'each" arsenic from the soil and transport it into the groundwater beneath the site, thereby causing the contamination to spread.) After the asphalt cap has been installed, the City will be required to conduct a Groundwater Monitoring Program to demonstrate that the capping and "in-place management" is working effectively and preventing contaminant migration. The cost for implementation of the RAP was estimated at approximately $185,000 and the necessary funds were appropriated and the Mayor and City Commission authorized the award of a contract on May 10, 2000. Concurrent with the on-going environmental assessment and remediation work, the City initiated plans for the complete renovation of the golf course. Those renovation plans include the construction of a new golf course maintenance facility within the existing maintenance yard area. Those elements of the construction of the new maintenance building, which will involve excavation, will require the contractor hired to perform the work, utilize special protective equipment and specially trained employees. (M&E) to remediate hazardous wastes within the maintenance yard area and because significant time and cost savings could be realized by consolidating all of the hazardous material work at the site under one contract, it has been determined to be in the City's best interest to have them complete those elements of the construction of the new maintenance building which will involve excavation, in conjunction with the previously authorized hazardous waste remediation work within the maintenance yard. The estimated cost for the "excavation related" elements of the maintenance facility construction plans are outlined below: 1. Permitting and construction oversight: $155,000 $170,000 $66,300 $31,000 Total Estimated Additional Cost: $422.300 The City's Program Manager for Parks and Facilities Construction, URS Corporation, has reviewed the contract amendment and agreed to the appropriateness of the proposed costs based on the defined scope of work. However, M & E will be performing additional soil testing as part of their scope of work to determine if the volume of soil to be excavated can be reduced. If the volume can be reduced, the associated costs for excavation, disposal, backfilling and compaction will also be reduced on a unit cost basis. The necessary funds for the renovation and environmental remediation of the Bayshore Golf Course are available from the $10,000,000 Gulf Breeze Loan proceeds, previously appropriated by the Mayor and City Commission for those purposes. Approximately $163,300 of the required funding for the additional scope of work in the M&E contract amendment was previously allocated for installation of new utility services, excavation and backfilling, paving, and contingency allowances associated with the construction of the Bayshore Golf Course Maintenance Yard. The difference, approximately $259,000, will be funded from the unallocated Gulf Breeze Loan proceeds. Therefore, the Administration recommends the City Commission approve a contract amendment, up to the amount of $422,300, to the contract with Metcalf & Eddy, Inc., for the environmental restoration of the hazardous waste contamination at Bayshore Golf Course Maintenance Facility; said amendment for the construction of a stormwater drainage system water and sanitary sewer services and building foundation preparation for the:ta hor f Course maintenance facility.
