A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, SETTING A FIRST READING PUBLIC HEARING TO
CONSIDER A PROPOSED AMENDMENT TO THE CITY OF MIAMI BEACH
COMPREHENSIVE PLAN CONSISTING OF:
An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida,
Amending the City of Miami Beach Comprehensive Plan; by Modifying Part Ii: Goals,
Objectives and Policies; by Modifying Objective 1: Land Development Regulations, of
the Future Land Use Element by Adding Policy Regarding School Siting Requirements
as Required by State Statute; by Modifying Objective 2: Comprehensive Plan
Coordination, of the Intergovernmental Coordination Element by Adding Policy
Regarding Requirements for Coordination with the Miami-Dade County School Board
as Required by State Statute; by Modifying Part I: Data and Analysis, by Modifying
Chapter I, Future Land Use Element by Adding Data and Analysis Pertaining to
School Capacities, Enrollment and Projections; And, Directing Transmittals of this
Ordinance and All Applicable Documents to Affected Agencies; Providing for
Repealer, Severability, Inclusion in the Comprehensive Plan and an Effective Date.
WHEREAS, the Planning Board considered the ordinance at its May 25, 1999 meeting, and
which time the Board recommended approval of the amendment; and
WHEREAS, pursuant to Section 118-164 of the Code of the City of Miami Beach, Florida,
in cases in which the actual list of permitted, conditional or prohibited uses within a zoning category,
or a change to the actual zoning map designation for a parcel or parcels of land is proposed, the City
Commission shall provide for public notice and hearings by holding two advertised public hearings
on the proposed ordinance, at least one hearing held after 5 :00 p.m. on a weekday; and
WHEREAS, to enable the City Commission to hear the proposed amendment in a timely
manner on first reading at its June 23, 1999 meeting, the Administration is requesting that the public
hearing be set at this time;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a first reading public
hearing to consider an amendment to the City of Miami Beach Comprehensive Plan adding required
language to the text of the Comprehensive Plan regarding school siting and coordination with the
Miami-Dade Public Schools (school board), is hereby scheduled on Wednesday, June 23, 1999 at
5: 15 p.m. in the City Commission Chambers at 1700 Convention Center Drive, Miami Beach,
Florida, and the City Clerk is hereby authorized and directed to publish and distribute the appropriate
public notice of said public hearing at which time all interested parties will be heard.

RECOMMENDATION
The Administration recommends that the City Commission set the required first reading public
hearing for 5:15 P.M. on June 23, 1999 for this proposed amendment to the text of the City of
Miami Beach Comprehensive Plan adding required language to the text of the Comprehensive Plan
regarding school siting and coordination with the Miami-Dade Public Schools (School Board).
BACKGROUND
Recent State legislation requires that any local government that fails to incorporate school location
and collocation criteria into the comprehensive plan by the October 1, 1999 deadline will be
prohibited from amending their comprehensive plan as provided by section 163.3187(6), F.S.
Because of the si&nificance of this prohibition. it is vital that the City adopt the subject amendment
with the greatest possible uq~ency.
On May 25, 1999 the Planning Board held a public hearing, and voted to recommend approval of
the amendment. To enable the City Commission to hear the proposed amendment in a timely
manner on first reading at its June 23, 1999 meeting, the Administration is requesting that the
public hearing be set at this time.
