A RESOLUTION OF MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND
AUTHORIZING AMENDMENT NO. 2 TO THE CITY"S
AGREEMENT WITH EDAW, INC., FOR THE DESIGN OF
THE FLAMINGO/LUMMUS NEIGHBORHOOD RIGHT OF
WAY IMPROVEMENT PROJECT, BY INCREASING THE
NOT TO EXCEED FEE BY AN AMOUNT OF $278,806 TO
PROVIDE FOR ADDITIONAL SERVICES REQUIRED BY
THE ADDITION TO THE PROJECT OF $4,550,695 OF RDA-
FUNDED IMPROVEMENTS.
WHEREAS, on July 18, 2001, the Mayor and City Commission adopted Resolution
2001-24506, authorizing the execution of an Agreement between the City and EDAW, Inc.,
(Consultant) in the not to exceed amount of $1 ,840,000, for professional services for the
design of the Flamingo/Lummus Neighborhood Right of Way Improvement Project; and
WHEREAS, in the course of planning the Project, the City and Consultant identified
needed improvements that are located within the South Pointe and City Center
Redevelopment Areas, and thus are eligible for RDA funding: and
WHEREAS, funding for these improvements, in the total amount of $4,955,984,
was approved through Resolutions No. 2002-24732 and 2002-24733, and RDA
Resolutions 415-2002 and 416-2002; and
WHEREAS, approval of funding for these improvements resulted in the addition to
the Project of $4,550,695 in construction funding which created a substantial increase in
the amount of work required on the part of the Consultant; and
WHEREAS, the City requested an Additional Services fee proposal for this work
from Consultant; and
WHEREAS, the City retained the services of Engineering Management Consultants,
Pappas and Associates, to negotiate the fees for the required Additional Services: and
WHEREAS, Pappas and Associates negotiated an Additional Services fee of
$278,806, approximately 6.1 % of the added construction funding, which they determined to
be reasonable and recommend for approval.
NOW, THEREFORE BE IT DULY RESOLVED BYTHE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission approve
and authorize Amendment No.2 to City's Agreement with EDAW, Inc. for the design of

The City was able to secure an increase in construction funding which will
result in additional water and storm water improvements, and a greater
intensity of landscaping for the South Pointe RDA, City Center RDA and the
areas of Euclid Ave. and Meridian Avenues between 16th Street and Lincoln
Lane South. These additional fees for the additional work are necessary for the
AlE firm to successfully complete the project as desired by the City of Miami
Beach.

Item Summary/Recommendation:
On July 18, 2001, the City executed an agreement with EDAW for the design of the Flamingo
Neighborhood Right-of-Way Improvement Project with a not to exceed fee of $1,840,000. During the
course of planning the Project, improvements totaling $4,550,695 were identified as being eligible for RDA
funding. City Commission and Redevelopment Agency approval was obtained for this amount plus
anticipated soft costs. An additional services fee proposal was obtained from EDAW for design services
required to implement these improvements which were not part of the original project budget. The City
retained the services of Engineering Management Consultants Pappas and Associates to negotiate the
fees for the required additional services. Pappas and Associates negotiated a fee of $278,806 which they
determined to be reasonable and recommend for approval. The Administration recommends approval of
the resolution.
Adviso Board Recommendation:
The Historic Preservation Board has approved all of the additional proposed improvements.

ANALYSIS
On July 18, 2001, the Mayor and City Commission adopted Resolution 2001-24506
authorizing the execution of an Agreement between the City of Miami Beach and EDAW,
Inc.,in the not to exceed amount of $1,840,000 for Professional Services for the design of
the Flamingo/Lummus Neighborhood Right-of-Way Improvement Project. EDAW's
responsibilities for this project include urban design, landscape architecture, and
engineering services required for the planning and design of the project as well as
assistance with bidding and construction administration.
On December 6, 2001, EDAW proposed design cost estimates for improvements within the
Flamingo/Lummus Neighborhood. These cost estimates were organized into three
geographic bid packages, named A, Band C. Portions of each of these three bid
packages included cost estimates for improvements on rights-of-way (ROW) within either
the City Center or South Pointe Redevelopment Area.
On January' 30th, the Mayor and City Commission adopted Resolution 2002-24732
appropriating $1,504,297 from South Pointe RDA funds for improvements to areas of the
Flamingo neighborhood lying within the South Pointe RDA District, including Sixth Street
from Alton Road to Ocean Drive, and the blocks of Meridian Avenue, Jefferson Avenue,
Drexel Avenue, Michigan Avenue, Lenox Avenue and Euclid Avenue between Sixth and
Fifth Streets. On the same date the Commission adopted Resolution 2002-24733
appropriating $547,373 from City Center RDA funds for improvements to areas of the
Flamingo neighborhood lying within the City Center RDA District including Espanola Way
from Washington Avenue to Collins Avenue, 14th Lane from Collins Avenue to Ocean
Drive, Drexel Avenue from 16th Street to Lincoln Lane South, and 16th Street from Drexel
Avenue to Washington Avenue. These amounts covered only the improvements eligible
for general revenue funding and did not include stormwater and water improvements or the
cost of certain above ground improvements including curb and gutter and repaving that
may be eligible to be paid for with water and stormwater funding.
On May 8th, 2002, the RDA Board adopted Resolution 416-2002 authorizing the
appropriation of an additional $661,572 from City Center RDA funds for Flamingo
neighborhood streetscape, water and sewer, and stormwater improvements lying within the
City Center RDA District. On the same date, the RDA Chairman and Board adopted
Resolution 415-2002 authorizing the appropriation of an additional $2,242,742 of South
Pointe RDA funds for Flamingo neighborhood streetscape, water and sewer, and
stormwater improvements lying within the South Pointe RDA District.
Through these combined actions, the City added an additional $4,955,984 to the total
funding for the project, of which $4,550,695 was allocated for construction and the
remainder for soft costs. As a result, the City needs to amend its contract with EDAW for
the design of the Flamingo neighborhood improvements to reflect the substantial additional
work required. An additional services fee proposal for the improvements was obtained
from EDAW. The City retained the services of Engineering Management Consultants
Pappas and Associates to negotiate the fees for the required additional services. Pappas
and Associates negotiated a fee of $278,806, approximately 6.1 % of the construction
funding, which they determined to be reasonable and recommend for approval as indicated
in the attached letter.

Miami Beach, Florida (CITY) and EDAW, Inc. (CONSULTANT) for Professional Services associated
with the planning, design, permitting, bidding and award, construction administration and
reimbursables associated with the project areas consisting of the South Pointe Redevelopment Area
located within the Flamingo I Lummus neighborhood boundary (Sixth Street from Alton Road to
Ocean Drive and the blocks of Meridian, Jefferson, Drexel, Michigan, Lenox and Euclid Avenue from
Fifth to Sixth Streets) and the City Center Redevelopment Area within the Flamingo I Lummus

RECITALS
WHEREAS, the Agreement provides for the planning, design, bidding and award, construction
administration and reimbursables for the Flamingo I Lummus neighborhood (Project); and
WHEREAS, the planning effort for the Flamingo I Lummus neighborhood has been initiated; and
WHEREAS, professional Landscape Architectural and Engineering services for the planning,
design, bidding and award, construction administration and reimbursables for the project areas
consisting of the South Pointe Redevelopment Area located within the Flamingo I Lummus
neighborhood boundary (Sixth Street from Alton Road to Ocean Drive and the blocks of Meridian,
Jefferson, Drexel, Michigan, Lenox and Euclid Avenue from Fifth to Sixth Streets) and the City
Center Redevelopment Areas within the Flamingo I Lummus neighborhood boundary not previously
addressed under Amendment NO.1 (Espanola Way from Washington Avenue to Collins Avenue,
14th Lane from Collins Avenue to Ocean Drive) , that are within the existing geographic boundary of
the original ucope of services, and (Drexel Avenue from 16th Street to Lincoln Lane South and the
north side of 16th Street from Drexel to Washington Avenue) that are outside of the existing
geographic boundary of the original scope of services but are required to complement the planning,
design and construction efforts proposed for the entire neighborhood.
