A RESOLUTION APPROVING ACCEPTANCE OF OFFERS
OF SETTLEMENT ON CERTAIN PARCELS OF LAND TO BE
ACQUIRED IN THE CITY OF MIAMI BEACH , FLORIDA.
WHEREAS, the City Council of the City of Miami Beach,
Florida, heretofore authorized institution of condemnation
proceedings for the acquisition of the fee simple title to the
following parcels of land, to-wit:
PARCEL NO. ONE :
N 1/2 Block 11, ALTOS DEL MAR NO. 2 ,
according to the Plat thereof recorded in
Plat Book 4 at page 162 of the Public
Records of Dade County, Florida;
PARCEL NOS. THIRTEEN AND FOURTEEN:
Lots 5 & 6 , Block 13, ALTOS DEL MAR SUB.
NO. 2 , according to the Plat thereof recorded
in Plat Book 4 at page 162 of the Public
Records of Dade County, Florida;
PARCEL NO. THIRTY :
E 115 ' of Lots 5 & 6, Block 17, ALTOS DEL
MAR NO. 1 , according to the Corrected Plat
thereof recorded in Plat Book 31 at page 40
of the Public Records of Dade County, Florida;
PARCEL NOS. THIRTY-EIGHT AND THIRTY-NINE :
Lots 1 & 2 , Block 19, ALTOS DEL MAR NO. 1,
according to the Corrected Plat thereof
recorded in Plat Book 31 at page 40 of the
Public Records of Dade County, Florida;
PARCEL NO. FORTY-TWO :
Lot 5, Block 19 , ALTOS DEL MAR NO. 1,
according to the Corrected Plat thereof
recorded in Plat Book 31 at page 40 of the
Public Records of Dade County, Florida;
for use for public park and recreational purposes; and
WHEREAS , pursuant to said resolution, appropriate
condemnation proceedings were instituted in the Dade County Circuit
Court for said purpose, said proceedings entitled City of Miami
Beach v. Joe Kasdin, et al. ; and
WHEREAS , prior to impanelling of a jury, the proposed
offers of settlement were made by the owners of said parcels , by
and through their attorneys , as follows :
1. For Parcel No. 1 , owned by Joe Kasdin and
Holloway Coffee Corporation, the sum One
Hundred Twenty-seven Thousand Two Hundred and
33/100 Dollars ($127, 200 . 33) , plus the sum of
Twelve Thousand Seven Hundred Twenty and 02/100
Dollars ($12 ,720 . 02) for attorney 's fees, total
sum being One Hundred Thirty-nine Thousand Nine
Hundred Twenty and 35/100 Dollars ($139 , 920 . 35) ;

2. For Parcel Nos. 13 & 14 , owned by Adrian B.
Arganbright and Mary Alice Harwood, the sum
One Hundred Twenty-eight Thousand Three Hundred
Seventy-seven and 92/100 Dollars ($128 , 377. 92) ,
plus the sum of Twelve Thousand Eight Hundred
Thirty-seven and 79/100 Dollars ($12, 837. 79) for
attorney' s fees , total sum being One Hundred Forty-
one Thousand Two Hundred Fifteen and 71/100 Dollars
($141, 215. 71) ;
3. For Parcel No. 30, owned by Henry Goldberg, as
Trustee for Mirriam Salzman, Stella Goldberg
and Lillian Shaw, the sum Eighty-six Thousand Seven
Hundred Twenty-one and 11/100 Dollars ($86,721. 11) ,
plus the sum of Eight Thousand Six Hundred Seventy-
two and 11/100 Dollars ($8 , 672. 11) for attorney ' s
fess , total sum being Ninety-five Thousand Three
Hundred Ninety-three and 22/100 Dollars ($95, 393. 22) ;
4 . For Parcel Nos . 38 & 39 , owned by Selma Lieberman,
Ruth Philip, and Lucille Cohen the sum One Hundred
Twenty-nine Thousand Fifty-eight and 21/100 ($129, 058. 21) ,
plus the sum of Twelve Thousand Nine Hundred Five and
82/100 Dollars ($12, 905. 82) for attorney' s fees , total
sum being One Hundred Forty-one Thousand Nine Hundred
Sixty-four and 03/100 Dollars ($141, 964. 03) ;
5. For Parcel No. 42, owned by Mary H. Gardener,
a/k/a Mrs . Henry O. Shaw, the sum Seventy-one Thous-
and Nine Hundred Eighteen and 68/100 Dollars ($71, 918. 68) ,
plus the sum of Seven Thousand One Hundred Ninety-one and
87/100 Dollars ($7,191. 87) for attorney' s fees, total
sum being Seventy-nine Thousand One Hundred Ten and
55/100 Dollars ($79, 110. 55) ;
and a consent Judgment entered accordingly, and
{ WHEREAS , the City Attorney, the City Manager, Mr. S . Z.
Bennett, the City ' s Real Estate Consultant, and Mr. John R. Farrell,
Special Counsel for the City, have each recommended to the City
Council that the acceptance of said offers of settlement are
financially advantageous to the City and in its best interests; and
WHEREAS , the City Council of the City of Miami Beach,
Florida, has duly considered said offers of settlement and said
recommendations , and now being fully advised in the premises, it
is, therefore,
RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA, that the said offers of settlement, as hereinabove recom-
mended, be_ and the same are hereby accepted and the City Attorney be
and he is hereby authorized and directed to take all legal steps
necessary to effectuate and execute said offers of settlement and
the proper financial officers of the City be and they are hereby
authorized and directed to make all payments pursuant to said
Judgment as required by law.
