RESOLUTION NO. 74-14453
A RESOLUTION REQUESTING AND AUTHORIZING
CITY OF MIAMI BEACH PLANNING BOARD TO
CONSIDER APPROPRIATE AMENDMENTS TO THE
CITY'S COMPREHENSIVE ZONING ORDINANCE
REGULATING THE TRANSFORMATION AND CON-
VERSION OF EXISTING APARTMENT BUILDINGS
TO CONDOMINIUM USE AND REGULATING SUCH
USE.
WHEREAS, the precipitate and unregulated transformation
and conversion of existing apartment houses to condominium use and
ownership endangers public health, safety and general welfare of
the community, and
WHEREAS, Zoning Ordinance 1891, being the Comprehensive
Zoning Ordinance of the City of Miami Beach, makes no reference
or allusion to the term "condominium" thereby posing and creating
substantial questions as to the degree, if any, of regulation which
may be imposed upon such use; and
WHEREAS , the City Council of the City of Miami Beach deems
it necessary in order to effectuate the purposes of said Comprehen-
sive Zoning Ordinance of the City of Miami Beach and to protect
and ensure public health, safety and general welfare, to adopt
appropriate amendments thereto.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, pursuant to the provisions of
Section 16 of said Comprehensive Zoning Ordinance, requests the
Planning Board of the City of Miami Beach, Florida, for its study,
recommendations , and report, appropriate amendments to Ordinance
1891, being the Comprehensive Zoning Ordinance of the City of Miami
Beach, so as to include and define the term "condominium" ; that the
conversion of an existing apartment building to a condominium shall
be deemed a change of use and that before such change of use be
approved, that compliance shall be had with all zoning regulations
applicable to apartment house use including the providing of rdquired F
1 off-street parking; and compliance with the requirements of the
South Florida Electrical and Building Codes ; and

BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that a certified copy of this Resolution
be transmitted to the City of Miami Beach Planning Board for its
appropriate action with all reasonable speed.
