Resolution 74-14488 RESOLUTION NO. 74-14488 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A SPECIAL ELECTION TO FILL THE UNEXPIRED TERM OF THE OFFICE OF COUNCILMAN, GROUP IV. WHEREAS , a vacancy has arisen in the office of Council- man in the City of Miami Beach, Florida, Group IV, by reason of the incumbent therein having been elected to fill the vacancy occurring in the office of Mayor of the City of Miami Beach occasioned by the death of Mayor Chuck Hall. WHEREAS , the City Councilof the City of Miami Beach has duly determined that said vacancy should be filled by a Special Election, as authorized under Section 28 of the Charter of the City of Miami Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That a Special Election is hereby called and directed to be held in the City of Miami Beach, Florida, from 7 : 00 o 'clock A.M. until 7 : 00 o' clock P.M. on the 5th day of November, 1974, for the purpose of electing a Councilman to fill the unexpired term of that office of councilman designated as Group IV the term of which expires on November 4 , 1975. SECTION 2. That the appropriate and proper Dade County election officials shall conduct the said Special Election hereby called, except for the canvassing of the returns of said Special Election, which duty shall be performed by the City Council. The official return sheets from each precinct shall be furnished to the City Clerk of the City of Miami Beach as soon as the polls are closed after said Special Election. The official certification of the results of said Special Election shall be made by the City Council of the City of Miami Beach. SECTION S. That the said voting precincts in the City for said Special Election shall be as established by the proper and appropriate Dade County election officials . All electors shall vote at the polling places in the voting precincts in which the official registration books show that the said electors reside. Registration of persons desiring to vote in said Special Election shall be in accordance with the general law of the State governing voter registration. SECTION 4 . That thirty days ' notice of said Special Election shall be given by publication in the Miami Beach Sun Reporter and the Miami Beach Times, newspapers published in the City of Miami Beach, Florida. Such publication shall be made at least once each week for four consecutive weeks during said period of thirty days . SECTION 5. That the Notice of Election shall be substantially in the following form: "CITY OF MIAMI BEACH, FLORIDA NOTICE OF SPECIAL ELECTION" "NOTICE IS HEREBY GIVEN that a Special Election has been called by the City Council of the City of Miami Beach, Florida, and will be held in said City from 7 : 00 o 'clock A.M. until 7 : 00 o ' clock P.M. on the 5th day of November, 1974, for the purpose of electing a Councilman to fill the unexpired term of the office of Councilman, Group IV, City of Miami Beach, Florida; said term expiring on November 4, 1975. SECTION 6 . That the voting shall be on voting machines and that the official ballots thereon shall be in substantially the following form: "OFFICIAL BALLOT" "CITY OF MIAMI BEACH, FLORIDA SPECIAL ELECTION NOVEMBER 5, 1974 FOR ELECTING A COUNCILMAN TO FILL THE UNEXPIRED TERM OF THE OFFICE OF COUNCILMAN, GROUP IV, OF THE CITY OF MIAMI BEACH, FLORIDA" MARK A CROSS (X) AFTER YOUR CHOICE : Vote for one (1) only (Here insert names of candidates) / / / / The ballot shall be so prepared that the names of qualified can- didates for the office to be filled shall appear on said ballot in alphabetical order according to surname, and that the said ballot and its preparation shall be such so as to be in compliance with the laws of the State, of Florida with respect to the use of mechanical voting machines. SECTION 7 . That absentee voters participating in said Special Election shall be entitled to cast their ballots in accordance with the provisions of the laws of the State of Florida with respect to absentee voting. SECTION 8. Any person desiring to qualify as a candidate for the unexpired term of the office of Councilman, Group IV of the City of Miami Beach, Florida, must quality as such candidate not earlier than October 1, 1974 and not later than 5: 00 o' clock P.M. on October 15, 1974. A qualifying fee of One Hundred Twelve Dollars and fifty cents ($112. 50) shall be paid to the City Clerk of the City of Miami Beach, Florida, at the time of qualifying as such candidate, or, in the alternative, by filing, with the City Clerk not later than 5 o 'clock P.M. on the 5th day of October, 1974 a petition approving his candidacy signed by not less than Five Hundred (500) qualified and registered voters. Said candidate, take, sign, and subscribe to an oath or affirmation in writing, in substantially the form prescribed by Section 40 of the Charter of the City of Miami Beach. SECTION 9 . The candidate receiving the highest number of votes cast in said Special Election shall be deemed to be elected. In case two or more persons receiving an equal and high- est number of votes , such persons shall draw lots to determine who shall be deemed the successful candidate. - 2 - OFFICE OF THE CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 X SECTION 10. That the City of Miami Beach shall pay all expenses for conducting this Special Election and will pay the same directly to all persons or firms, upon receipt of invoice or statement approved by the Supervisor of Elections of Dade County, Florida. SECTION 11. That this Resolution shall be effective immediately upon its passage. PASSED and ADOPTED this 23rd day of September, 1974.
