A RESOLUTION CANCELLING CERTAIN LIENS OF
WHITEWAY LIGHTING PROJECT (WW-152)
AFFECTING CERTAIN PARCELS OF LAND ON THE
WEST SIDE OF COLLINS AVENUE, AND BEING
PORTIONS OF ALTOS DEL MAR NO. 2, PLAT
BOOK 4 , PAGE 162, AND CORRECTED PLAT OF
ALTOS DEL MAR NO. 1 , PLAT BOOK 31, PAGE 40 .
WHEREAS , by appropriate resolutions, the City Council
of the City of Miami Beach created that certain Whiteway Improve-
ment and Assessment District, to-wit, WW-152 , and affecting
certain parcels of land on the west side of Collins Avenue and
being situate in ALTOS DEL MAR NO. 2, according to Plat Book 4, at
Page 162 , and CORRECTED PLAT OF ALTOS DEL MAR NO. 1 , according
to Plat Book 31 , at Page 40, and
WHEREAS , upon completion of the said Improvement,
Improvement Assessment Liens were certified on May 15, 1974
against the following parcels, each parcel being assessed for
$140.18:
Lots 1, 2 and 3, Block 12; and Lot 1,
Block 13; and Lot 1, Block 15, ALTOS DEL
MAR NO. 2 , according to the plat thereof
recorded in Plat Book 4 , Page 162 , of the
Public Records of Dade County, Florida, and
Lots 1 and 6 , Block 18; and Lot 6 , Block
19 ; and Lot 1 , Block 20, CORRECTED PLAT OF
ALTOS DEL MAR NO. 1, according to the plat
thereof recorded in Plat Book 31 , Page 40,
of the Public Records of Dade County, Florida,
and
WHEREAS , hereinabove described parcels of land were the
subject matter of certain condemnation suits entitled City of
Miami Beach v. Kasdin, et al. , Case No. 72-21184 , and City of
Miami Beach v. Filosof Investment Properties , Inc. , Case No.
73-19856, and
WHEREAS , City of Miami Beach acquired title to the
hereinabove described parcels of land while said liens were
proposed and pending but before the same became certified liens ,
and
WHEREAS , said liens as certified should be cancelled of
record inasmuch as title to said parcels is now vested in the
City of Miami Beach.
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that Whiteway Improvement liens
in Whiteway Improvement and Assessment District 152 on the
hereinabove described parcels , in the total principal amount of
$981. 26 , be and the same are hereby cancelled and the financial
officer of the City of Miami Beach be and he is hereby authorized
and directed to make appropriate notation and record of such
cancellations in the appropriate records of the City of Miami
Beach.
