RESOLUTION NO. 81-16804
A RESOLUTION OF THE CITY COMMISSION OF MIAMI
BEACH, FLORIDA, AUTHORIZING THE ABANDONMENT BY
QUIT CLAIM DEED, OF A PORTION OF A CITY
RIGHT-OF-WAY EASEMENT WEST OF LOT 45 OF THE COR-
RECTED PLAT OF STAR ISLAND AS RECORDED IN PLAT
BOOK 31 AT PAGE 60 OF THE PUBLIC RECORDS OF DADE
COUNTY, FLORIDA; AUTHORIZING A REVOCABLE
PERMIT ALLOWING FOR THE PLACEMENT OF A FENCE,
CONNECTING WALL AND LANDSCAPING ON A PORTION OF
THE CITY RIGHT-OF-WAY EASEMENT ABUTTING THE
LAND SUBJECT TO THE AFOREMENTIONED VACATED
RIGHT-OF-WAY; AUTHORIZING THE EXECUTION OF BOTH
THE QUIT CLAIM DEED AND REVOCABLE PERMIT BY THE
VICE MAYOR AND DEPUTY CITY CLERK.
WHEREAS, the owners of the real property have petitioned
the City Commission of the City of Miami Beach to vacate a portion of
City right-of-way described as Parcel 1 in the survey attached to
the attached Quit Claim deed; and
WHEREAS, said portion of right-of-way hereinafter de-
scribed as Parcel 1 has been abandoned by the public; and
WHEREAS, the vacation of the subject Parcel 1 is deemed to
be in the best interest of the City of Miami Beach and its citizens;
and
WHEREAS, the Public Works department recommends that the
City retain a utility easement within said Parcel 1; and
WHEREAS, the vacation of right-of-way shall be evidenced
by the execution of a Quit Claim deed; and
WHEREAS, the aforementioned owners of real property have
also petitioned the City to allow the construction of a fence, con-
necting wall and landscaping on City right-of-way abutting said
Parcel 1; and
WHEREAS, the Public Works department has recommended the
allowance of such use of City right-of-way subject to the restric-
tions of the attached Revocable Permit.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City surrender all its
right, title and interest to the property described in the attached
Quit Claim deed described as Parcel 1 and authorizes the Vice Mayor
and Deputy City Clerk to execute the attached Quit Claim deed and
Revocable Permit.
