RESOLUTION NO. 81-16839
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, REQUESTING THE DADE COUNTY
COMMISSION TO CANCEL OR RESCIND THOSE PORTIONS OF
THE DADE COUNTY FRANCHISE AGREEMENT WITH FLORIDA
POWER AND LIGHT THAT CONCERNS THE CITY OF MIAMI
BEACH FOR A MINIMUM OF TWO YEARS SO THAT THE CITY
MAY NEGOTIATE A FRANCHISE AGREEMENT WITH FLORIDA
POWER AND LIGHT, AND REQUESTING THAT THIS RESOLU-
TION BE CIRCULATED TO EACH MUNICIPALITY WITHIN DADE
COUNTY.
WHEREAS, Dade County has a franchise agreement with Florida
Power and Light which grants Florida Power and Light the right to
operate in the unincorporated as well as in the corporated areas of
Dade County, and
WHEREAS , Florida Power and Light has stated that they will
pay franchise fees collected in Miami Beach to Dade County when the
Miami Beach franchise expires in January, 1982 , and
WHEREAS, the City of Miami Beach has been frustrated and
unable to realistically negotiate a new franchise agreement because the
Dade County franchise is effectively being used as a club for Florida
Power and Light against the people of Miami Beach.
WHEREAS, other municipalities in Dade County are in similar
circumstances and will find they have no real negotiating powers with
Florida Power and Light so long as Dade County keeps the municipalities
in a hostage position with their franchise.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA that the City Commission of the City
of Miami Beach requests the Dade County Commission to cancel or rescind
those portions of the Dade County franchise agreement with Florida
Power and Light that concerns the City of Miami Beach for a minimum of
two years so that the City may negotiate a franchise agreement with
Florida Power and Light, and requesting that this Resolution be circu-
lated to each municipality within Dade County.
