A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA APPROVING AN AMENDMENT
TO THE CONTRACT WITH MALCOLM PIRNIE, INC. , CON-
SULTING ENGINEERS, AUTHORIZING UP TO $15 ,000 IN
EXPENDITURES FOR FEASIBILITY STUDIES AND EXPERT
WITNESS SERVICES IN CONNECTION WITH THE CITY'S
PROPOSED DEEP CURRENT SEWAGE ASSIMILATION PRO-
JECT.
WHEREAS, the City, through its special counsel, Linton
Lovett, may seek to settle a dispute with the United States Environ-
mental Protection Agency and other local and State government autho-
rities concerning the City' s effort to implement a Deep Current
Sewage Assimilation project; and
WHEREAS, Malcolm Pirnie, Inc. and Ray L. Hart & Asso-
ciates, Inc. have formed a joint venture since the original contract
with the City and now serve as the City' s consulting engineers, with
specialized knowledge of the City' s sewage system; and
WHEREAS , said engineers are well qualified to serve the
City as expert witnesses in the above-described litigation and as
consultants on the above-described sewage projects; and
WHEREAS , said engineers have an existing contract with the
City to serve as consulting engineers with respect to the City' s
sewer system, including the preparation of feasibility studies , the
preparation of applications and supporting documents, and the imple-
mentation of pilot studies for sewage treatment systems,
NOW, THEREFORE, BE IT RESOLVED by the City Commission of
the City of Miami Beach, Florida, that the December 11, 1972 con-
tract between the City and said engineering firm is hereby amended
in accordance with the attached Amendment of Agreement, and the
Mayor is hereby authorized to execute said Amendment on behalf of
the City.

AMENDMENT OF AGREEMENT
Between City of Miami Beach, Florida and Malcolm Pirnie,
Inc. , consulting environmental engineers, November 18 , 1981.
This Amendment is to the Agreement dated December 11, 1972
between the City of Miami Beach (CITY) and Malcolm Pirnie, Inc. in
association with Ray L. Hart & Associates, Inc. ("MALCOLM PIRNIE")
and grants the latter authority to provide expert witness and en-
gineering services in connection with the City' s proposed deep cur-
rent sewage assimilation project and the Federal litigation
involving said project.
The Contract between the City and Malcolm Pirnie is hereby
amended to include Malcolm Pirnie' s services in providing the City a
preliminary feasibility study pertaining to deep current sewage as-
similation, including preliminary estimates of costs for preliminary
sewage treatment facilities, and extended ocean outfall and diffuser
system and modifications to the existing pump stations required to
pump through the ocean outfall system, together with the operating
costs of the proposed system versus the existing system with com-
plete treatment, at the Virginia Key Sewage Treatment plant. The
scope of the work will not be sufficient to support the preparation
of applications to any regulatory agency for a variance from State
law, or to EPA for approval or funding of the project, nor will the
scope include any studies or discussion pertaining to the ability of
the ocean to assimilate the proposed sewage effluent.
Malcolm Pirnie cannot establish a lump sum fee for the
performance of the work since the scope of the work is not suffi-
ciently defined. Accordingly, the City shall pay Malcolm Pirnie
fees for these services rendered to the City in accordance with the
1972 Contract as amended provided that the total fees rendered for
services under this Agreement shall not exceed Fifteen Thousand
($15,000. 00) Dollars without additional written authorization by the
City.
