A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, OPPOSING THE PROPOSED RULES OF
THE FLORIDA DEPARTMENT OF NATURAL RESOURCES,
CHAPTER 16 Q-17, FLORIDA ADMINISTRATIVE CODE,
REGARDING SOVEREIGNTY SUBMERGED LAND LEASES;
REQUESTING THE BOARD OF TRUSTEES OF THE INTERNAL
IMPROVEMENT TRUST FUND TO POSTPONE APPROVAL OF SAID
RULES UNTIL SUCH TIME AS A STUDY COMMISSION HAS BEEN
APPOINTED, HAS REVIEWED SAID RULES, AND HAS RECEIVED
FORMAL INPUT FROM LOCAL GOVERNMENTS, THE MARINE
INDUSTRY, AND THE GENERAL PUBLIC.
WHEREAS, the State of Florida Department of Natural Resources has
prepared proposed rules regarding increased lease fees for sovereignty
submerged lands, and
d ! WHEREAS, the Governor and Cabinet, sitting as the Board of Trustees of
the Internal Improvement Trust Fund, have the authority to approve, deny, or
modify said rules, and
WHEREAS, the promulgation of said rules would be detrimental to marine
oriented localities such as the City of Miami Beach, the Marine Industry, and the
General Public, and
WHEREAS, local governments and affected parties have not had adequate
opportunity to recommend alternative formulas for assessing the value of
sovereignty submerged lands,
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City
of Miami Beach, Florida that the City of Miami Beach is opposed to the approval
by the Board of Trustees of the Internal Improvement Trust Fund of Chapter 16
Q-17, prior to the establishment of a study commission to receive input from
local governments and affected parties regarding sovereignty submerged land
leases.
BE IT FURTHER RESOLVED, it is recommended that said study
commission contain a representative of the City of Miami Beach.
