A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH TERMINATING THE CONTRACT BETWEEN
THE CITY OF MIAMI BEACH AND MARION RECREATION
CORPORATION FOR THE NORMANDY SHORES AND BAYSHORE
GOLF COURSES CONCESSIONS ; MAKING DEMAND FOR PAY-
MENT OF AMOUNT IN ARREARAGE DUE TO THE CITY OF
MIAMI BEACH FROM MARION RECREATION CORPORATION
UNDER SAID CONTRACT; RATIFYING THE FILING OF CASE
NO. 81-18980 ; AND AUTHORIZING THE CITY ATTORNEY
AND CITY ADMINISTRATION TO PURSUE ALL APPROPRI-
ATE LEGAL AVENUES TO EFFECTUATE THE PURPOSE OF
i THIS RESOLUTION.
WHEREAS, by Resolution No. 78-15723 , the City Commission
of the City of Miami Beach awarded the concession contract for the
concession at the Normandy Shores and Bayshore Golf Courses to Marion
Recreation Corporation; and
WHEREAS, the concession contract provides for termination
for violation of the terms of the specifications, proposal , and contract,
and for failure to perform in a manner satisfactory to the City as per
contract specifications; and
WHEREAS , the violations, failure to perform and default on the
par'- of Marion Recreation Corporation consist of unpaid rental arrear-
ages, as of this date, in the an of ONE HUNDRED SIXTY-TWO THOUSAND SIX
HUNDRED TWENTY-TWO AND 75/100 ($162 ,622 . 75) ; and
WHEREAS, the failure to perform further consists of Marion
Recreation Corporation' s neglect of its obligation to provide extermina-
tion service for all pests and rodents as required under the concession
contract;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, that the concession contract between
Marion Recreation Corporation and the City of Miami Beach, awarded by
Resolution No. 78-15723 and amended by Resolution No. 79-16007 , is
declared terminated; and any and all occupational licenses issued in
connection therewith are revoked; and the filing of Circuit Court Case
No. 81-18980 is ratified. The City Commission directs Marion Recreation
Corporation to vacate the premises of Normandy Shores and Bayshore Golf
Courses immediately. The City Commission further demands full payment
from Marion Recreation Corporation for all amounts due and outstanding
under said concession contract;
BE IT FURTHER RESOLVED that the City Attorney and City
Administration are hereby authorized and directed to pursue all appro-
priate legal avenues to effectuate the purpose of this Resolution in
the name of and on behalf of the City of Miami Beach, Florida.
