2002-25063 ResoRESOLUTION NO. 2002-25063 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AUTHORIZING THE MAYOR AND CITY COMMISSION TO GRANT A NON-EXCLUSIVE EASEMENT TO FLORIDA POWER & LIGHT COMPANY (FP&L) FOR THE PROVISION OF UNDERGROUND DISTRIBUTION FACILITIES, A TRANSFORMER PAD AND A VAULT AT THE MIAMI BEACH REGIONAL LIBRARY; AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND RECORD THE EASEMENT FOR THE REQUIRED UNDERGROUND FACILITIES, TRANSFORMER PAD AND VAULT. WltEREAS, the City owns the property adjacent to the Bass Museum, between 22nd and 23rd Streets and Collins Avenue (Property); and WltEREAS, as part of the City's Cultural Campus project a new Regional Library with parking facilities were approved to be constructed on this Property; and WHEREAS, on September 23, 1998 the Mayor and City Commission adopted Resolution No. 98-22904 awarding Robert A.M. Stem Architects a contract for the design of the Regional Library and parking facilities; and WHEREAS, following the April 10, 2002, Resolution No. 2002-24828 awarding Tower Group the construction contract for the Regional Library, work commenced on May 6, 2002 and has been proceeding on schedule with an anticipated substantial completion date of August 5, 2003; and WREREAS, in order to supply the electrical power to the Regional Library, Florida Power and Light (FP&L) will install a transformer on a pad with underground feeders and a switchgear in a vault room at the Property; and WHEREAS, to energize the system, FP&L is requesting the City to grant the attached easement for the pad mount transformer, the vault and the underground transmission ducts area. NOW, THEREFORE, BE IT DULY RESOLVED BY TIYE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve the grant of the attached Non-Exclusive Easc~ment to Florida Power & Light Company (FP&L) for the provision of underground distribution facilities, a transformer pad and a vault at the City's Regional Library site, and authorize the Mayor and City Clerk to execute and record the Easement for the required underground facilities and transformer pad. BACKGROUND Following a City Commission workshop in January 29, 1997, the City determined the area adjacent to the Bass Museum, between 22nd and 23rd Streets and Collins Avenue as the site for a Regional Library with parking facilities. In September 23, 1998 the Mayor and City Commission adopted Resolution No. 98-22904 awarding Robert A.M. Stern Architects a contract for the design of the Regional Library and parking facilities. On April 10, 2002, Resolution No. 2002-24828 was adopted awarding the construction contract for the Regional Library to the Tower Group. Construction commenced on May 6, 2002 and has been proceeding on schedule with an anticipated substantial completion date of August 5, 2003. In order to supply the electrical power to the Regional Library and its facilities, Florida Power and Light (FP&L) needs to install a transformer on a pad with underground feeders adjacent to the parking area (see attached sketch "A") and a vault for the switchgear within the building. To energize the system, FP&L is requesting the City to grant an easement for the pad mount transformer, the vault and the underground transmission ducts area within the parking area. ANALYSIS Following the recommended location by F.P.&L. of the proposed underground ducts, the transformer pad and the vault room, and the review/approval by the Architects/Engineers and the Contractor, Public Works found no conflict with existing underground utilities or land use and, therefore, recommends granting a non-exclusive easement. The non- exclusive easement will be granted to FP&L for the installation and maintenance of an underground transmission system, a transformer pad and a vault room, within that portion of the Regional Library site as shown in the attached legal description and sketch. The easement will be valid for the duration of said structure and facilities being in service and will revert to the City in case of removal of such electrical services. CONCLUSION The Administration recommends the granting of the easement by the Mayor and City Commission to Florida Power & Light for the underground utilities, the transformer pad and vault room, and the execution and recording of said easement by the Mayor and City Clerk, to allow energizing of the Miami Beach Regional Library building and its facilities.
