A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING THE EXECUTION OF
AN AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT
OF TRANSPORTATION, CONCERNING THE CONSTRUCTION OF
CERTAIN FACILITIES IN CONNECTION WITH DEPARTMENT
PROJECT NOS. 87000-3651 AND 3652 .
WHEREAS , the City Commission of the City of Miami Beach deems
it in the best interest of the citizens of Miami Beach to enter into an
agreement with the State of Florida Department of Transportation, the
terms of which are familiar to the City Commission and which contract
is included in the agenda package for the meeting at which this Resolu-
tion was adopted, and
WHEREAS , the City Manager recommends the City enter into said
agreement and the City Attorney has approved same as to form and legal
sufficiency,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk be here-
by authorized and directed to enter into said attached agreement for
and on behalf of the City of Miami Beach.

AGREEMENT
THIS AGREEMENT, entered into this ( day of
Trelf) ^tuA , 1982 , by and between the STATE OF FLORIDA
DEPARTMENT OF TRANSPORTATION, hereinafter called "Department" , and
CITY OF MIAMI BEACH, FLORIDA called "City" .

WITNESSETH :
WHEREAS, the City has determined that it is in its interest
to pay the costs of construction of certain facilities in connection
with Department Project Nos. 87000-3651 and 3652 .
NOW, THEREFORE, in consideration of the premises and the
covenants contained herein, the parties agree:
1. The Department will include in the above Project the
construction of four french drains and eight associated structures
in accordance with plans and specifications approved by the parties,
at an estimated cost of $ 24,000.00

2. Upon exectuion of this Agreement, the City will deposit
with the Department the sum of $24,000.00 , to be used by the
Department for payment of the cost of construction of the above-
described facilities.
3 . The Department shall maintain construction costs records
which shall be open to inspection by the City at all reasonable times.
Upon completion, if the final costs are found to exceed the amount
deposited, the City will immediately pay the difference; if final
costs are less than the amount deposited, the Department will
immediately refund the difference.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement the day and year first above written.
