A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AUTHORIZING THE PAYMENT
OF WORKER' S COMPENSATION BENEFITS OF $16 , 622 . 00
(SIXTEEN THOUSAND SIX HUNDRED AND TWENTY TWO DOL-
LARS) IN PAST PRESENT AND FUTURE COMPENSATION
AND MEDICAL BENFITS TO FORMER CITY OF MIAMI BEACH
EMPLOYEE HENRY ATWELL AND FURTHER AUTHORIZING THE
PAYMENT OF $6 , 000. 00 (SIX THOUSAND DOLLARS) IN
ATTORNEY' S FEES IN FULL AND FINAL SETTLEMENT OF
ALL CLAIMS ARISING FROM INJURIES SUSTAINED IN THE
COURSE OF AND ARISING OUT OF HIS EMPLOYMENT WITH
THE CITY OF MIAMI BEACH.
WHEREAS, City of Miami Beach employee Mr. Henry
Atwell sustained injuries to his back on July 8 , 1977 , in
December, 1978 and on June 8, 1979, said injuries requiring
surgical correction; and
WHEREAS, said injuries were sustained in the course
of and arising out of Mr. Atwell' s employment as a Park At-
tendant with the City of Miami Beach; and
WHEREAS, Risk Management Services has determined and
recommended that it is in the best interest of the City to en-
ter into a settlement providing for the payment of Worker' s Com-
pensation to Mr. Atwell by the City of Miami Beach the sum of
$16, 622. 00 (SIXTEEN THOUSAND SIX HUNDRED AND TWENTY TWO DOLLARS)
in past, present and future compensation and medical benefits,
plus the sum of, $6, 000. 00 (SIX THOUSAND DOLLARS) in attorney' s
fees; and
WHEREAS, The City Commission deems it in the best in-
terest of the City of Miami Beach to enter into a final settle-
ment as herein set forth;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, that Risk Management
Services, Inc. , as the agent for the City of Miami Beach, is
hereby authorized to tender payment of $16 , 622. 00 (SIXTEEN
THOUSAND SIX HUNDRED AND TWENTY TWO DOLLARS) in past present
and future compensation and medical benefits and $6, 000. 00
(SIX THOUSAND DOLLARS) in attorney' s fees to Mr. Henry Atwell
in full and final settlement of all claims arising from in-
juries sustained in the course of and arising out of his em-
ployment with the City of Miami Beach.
