RESOLUTION NO. 82-16940
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA URGING CONGRESS AND THE
PRESIDENT TO AUTHORIZE AND INSTITUTE DEPORTA-
TION OF MARIEL REFUGEES CONVICTED OF SERIOUS
CRIMES AND/OR INCARCERATION OF SAID REFUGEES IN
GUANTANAMO BAY OR OTHER SIMILAR MILITARY IN-
STALLATIONS .
WHEREAS the massive influx of Mariel refugees from Cuba
during the last two years was in large measure the result of a fail-
ure of Federal immigration and administration policies; and
WHEREAS a significant portion of these refugees have en-
gaged in predatory conduct and criminal activities in the City of
Miami Beach and surrounding communities; and
WHEREAS the United States Constitution preempts local com-
munities from deportation or other measures to control such conduct
by these refugees; and
WHEREAS the exclusive jurisdiction of the United States
Government over these special refugees should properly include res-
ponsibility by the Federal Government for such persons;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COM-
MISSION OF THE CITY OF MIAMI BEACH that the President, Senate and
House of Representatives of the United States are urgently requested
to honor their responsibilities under the Refugee Act and Article I ,
X8 [3] United States Constitution, and to enact legislation to pro-
vide that these refugees shall, upon conviction for any felony, be
deported to their country of origin, and/or that upon such convic-
tions they be incarcerated by the United States Government in
Guantanamo Bay or other similar military installations.
