A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH AUTHORIZING THE CITY
ATTORNEY TO HIRE MORRIS ROSENBERG AS SPECIAL
COUNSEL TO THE CITY TO REVIEW AND FINALIZE THE
LANGUAGE OF THE "LEASE AND AGREEMENT FOR
PRIVATE DEVELOPMENT" BETWEEN THE CITY OF MIAMI
BEACH AND REYNOLDS CONSTRUCTION COMPANY; AND
AUTHORIZING THE PAYMENT OF SAID ATTORNEY FEES
FROM THE CONTINGENCY FUND AT A RATE OF $150
PER HOUR NOT TO EXCEED $5 ,000 .
WHEREAS , the City of Miami Beach is desirous of entering
into a "Lease and Agreement for Private Development" with the
Reynolds Construction Company to construct a multi-purpose hotel
and office complex next to the City' s Convention Center ; and
WHEREAS , said lease and agreement involves complex real
property financing, insurance, rental , and tax questions; and
WHEREAS, the City Attorney recommends the City hire
Morris Rosenberg, an outside independent attorney who is expert in
real estate contract law to review said agreement in order to
finalize the language therein.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City
Attorney is authorized to hire Morris Rosenberg as special counsel
to review the Reynolds Construction Company agreement at a rate of
$150 per hour not to exceed $5 ,000 .
