Resolution 82-17042 RESOLUTION NO. 82-17042 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE PAYMENT OF ONE-THIRD OF THE LEGAL FEES TO MR. ROBERT M. RHODES OR TERRY E. LEWIS FOR THEIR REPRESENTATION OF THE CITY ' S INTEREST BEFORE THE BLUE RIBBON COMMITTEE APPOINTED BY THE GOVERNOR AND CABINET OF THE STATE OF FLORIDA TO MAKE RECOMMENDATIONS OF RULES AND REGULATIONS FOR PUBLIC SUBMERGED LAND LEASES; AUTHORIZING THE PAYMENT OF SAID ATTORNEY 'S FEES AT A RATE OF $100 PER HOUR FOR MR. RHODES AND $85 PER HOUR FOR MR. LEWIS FROM THE CONTINGENCY FUND, NOT TO EXCEED THE AMOUNT OF $3 ,500 . WHEREAS, the Governor and Cabinet of the State of Florida sitting as the Board of Trustees of the Internal Improvement Trust Fund have the authority to promulgate rules and regulations, establish fees, and to execute leases with the owners of adjacent upland properties for the use of sovereignty submerged lands; and WHEREAS, the City of Miami Beach and the Redevelopment Agency are contemplating the establishment of certain marinas within its corporate limits; and WHEREAS, the City of Miami Beach and the Redevelopment Agency will be required to pay an annual lease fee for the use of submerged lands adjacent to such marinas; and WHEREAS, the State Department of Natural Resources acting as staff to the Board of Trustees, recently proposed an increase in such lease fees which would have dramatically affected public marinas throughout the state and in particular Miami Beach; and, WHEREAS, Mr . Robert M. Rhodes and Mr. Terry E. Lewis of the firm of Messer Rhodes and Vickers have been appointed to a committee which shall make recommendations to the Governor and Cabinet for the promulgation of the aforementioned rules, regulations, and lease fees; and, OFFICE OF THE CITY ATTORNEY-1700 CONVENTION CENTER DRIVE -MIAMI BEACH,FLORIDA 33139 WHEREAS, the Redevelopment Agency has retained the aforementioned attorneys to represent the agency ' s interest in said committee; and WHEREAS, the City of Miami Beach has the same or similar interest in said rules, NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Miami Beach, Florida that one-third of the fees to the aforementioned attorneys is authorized to be paid from the City ' s general fund contingency account at a rate of $100 per Mr . Rhodes and $85 per hour from Mr . Lewis, up to a maximum amount of $3 ,500 . I PASSED and ADOPTED this 16th day of June , 1982.
