2018-30228 ResolutionRESOLUTION NO. 2018 -30228 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, REQUIRING THE POSTING OF SIGNAGE IN THE FOLLOWING CITY DEPARTMENTS: PROCUREMENT, BUILDING, CODE COMPLIANCE, PLANNING, CITY CLERK, CITY MANAGER, CITY ATTORNEY, AND THE OFFICE OF THE MAYOR AND CITY COMMISSION, WHICH VISIBLY ADVISES POTENTIAL AND CURRENT CITY VENDORS, LOBBYISTS, DEVELOPERS, AND APPLICANTS FOR BUILDING PERMITS AND LAND USE APPROVALS, OF THEIR REQUIRED COMPLIANCE WITH ALL APPLICABLE STATE AND LOCAL ETHICS AND DISCLOSURE LAWS INCLUDING, BUT NOT LIMITED TO, CHAPTERS 112 AND 119 OF THE FLORIDA STATUTES, THE MIAMI -DADE COUNTY CONFLICT OF INTEREST AND CODE OF ETHICS ORDINANCE, AND THE MIAMI BEACH CITY CODE STANDARDS OF CONDUCT PROVISIONS, AS ALL SUCH LAWS MAY BE AMENDED FROM TIME TO TIME; AND, AUTHORIZING THE CITY MANAGER AND THE CITY ATTORNEY TO DEVELOP AND PREPARE THE REQUIRED SIGNAGE FOR APPROVAL BY THE CITY COMMISSION. WHEREAS, the City of Miami Beach is in the forefront of governmental entities in the State with regard to ethics legislation; and WHEREAS, in addition to County and State ethics, public record, and Sunshine Laws, the Code of the City of Miami Beach provides extensive ethics regulations including various conflict disclosures by public officials and City board members, campaign finance reform laws, lobbying restrictions and disclosures, and cone of silence requirements regarding City contracts; and WHEREAS, in order to promote greater awareness of, and heightened compliance with, the foregoing laws, as such laws may be amended from time to time, signage should be developed advising of such laws, and signage relative thereto should be posted in the following City Departments: Procurement, Building, Code Compliance, Planning, City Clerk, City Manager, City Attorney, and the Office of the Mayor and City Commission; and WHEREAS, such signage would serve to visibly advise potential and current City vendors, lobbyists, developers, and applicants for building permits and land use approvals, of their required compliance with all applicable state and local ethics and disclosure laws including, but not limited to, those set forth in Chapters 112 and 119 of the Florida Statutes, the Miami -Dade County Conflict of Interest and Code of Ethics Ordinance, and the Miami Beach City Code Standards of Conduct provisions; and WHEREAS, the City Manager and City Attorney should develop and prepare such signage, which shall be subject to City Commission approval prior to implementation. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby require the posting of signage in the following City Departments: Procurement, Building, Code Compliance, Planning, City Clerk, City Manager, City Attorney, and the Office of the Mayor and City Commission, which will visibly advise potential and current City vendors, lobbyists, developers, and applicants for building permits and land use approvals, of their required compliance with all applicable State and local ethics and disclosure laws including, but not limited to, Chapters 112 and 119 of the Florida Statutes, the Miami -Dade County Conflict of Interest and Code of Ethics Ordinance, and the Miami Beach City Code Standards of Conduct provisions, as all such laws may be amended from time to time; and, authorize the City Manager and the City Attorney to develop and prepare the required signage for approval by the City Commission.
