A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, REPEALING RESOLUTION NO.
2017 -30041 AND AUTHORIZING THE CITY MANAGER AND THE CITY
ATTORNEY TO TAKE ANY AND ALL ACTIONS AS MAY BE
REQUIRED TO UTILIZE ONE MIAMI BEACH, INC., A NOT -FOR-
PROFIT 501(C)(3) ORGANIZATION, FOR THE PUBLIC PURPOSE OF
ACCEPTING CHARITABLE DONATIONS TO BE USED FOR
PROVIDING EDUCATIONAL ENHANCEMENTS TO MIAMI BEACH
PUBLIC SCHOOLS; AND, FURTHER, REQUIRING THAT ALL FUTURE
DISBURSEMENTS BY ONE MIAMI BEACH, INC., BE RATIFIED BY
THE MAYOR AND CITY COMMISSION PRIOR TO DISBURSEMENT BY
ONE MIAMI BEACH, INC.
WHEREAS, the Finance and Citywide Projects Committee (FCWPC) made a
motion at its March 31, 2017 meeting recommending the creation of a non - profit
charitable 501(c)(3) entity to raise funds for public education within the City; and
WHEREAS, in Resolution No. 2017 - 30041, the Mayor and City Commission
accepted the recommendation of the FCWPC, and authorized the establishment of an
independent not- for - profit 501(c)(3) organization, to be named "Miami Beach for Better
Public Education ;" and
WHEREAS, the City Commission had previously established One Miami Beach,
Inc., as an independent not -for- profit organization, which was incorporated on February
11, 2014; and
WHEREAS, educating our children is key to the economic growth and welfare of
our nation, state, and local communities; and
WHEREAS, the utilization of One Miami Beach, Inc., to accept charitable
donations for providing educational enhancements to Miami Beach public schools will
alleviate the need to proceed with creating and establishing another 501(c)(3)
organization, such as "Miami Beach for Better Public Education," which was authorized
by Resolution No. 2017- 30041; therefore, Resolution No. 2017 -30041 should be
repealed in its entirety.
WHEREAS, at its February 14, 2018 meeting, the City Commission passed a
motion requiring that all future disbursements by One Miami Beach, Inc., be ratified by
the Mayor and City Commission prior to disbursement by One Miami Beach, Inc.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby repeal Resolution No. 2017 -30041 and authorize the City Manager
and the City Attorney to take any and all actions as may be required to utilize One
Miami Beach, Inc., a not - for - profit 501(c)(3) organization, for the public purpose of
accepting charitable donations to be used for providing educational enhancements to
Miami Beach public schools; and, further, requiring that all future disbursements by One
Miami Beach, Inc., be ratified by the Mayor and City Commission prior to disbursement
by One Miami Beach, Inc.
