Resolution 82-17069 RESOLUTION NO. 82-17069 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING TRANSMISSION TO THE DADE COUNTY PROPERTY APPRAISER INFORMATION SPECIFIED IN SEC. 200.069, FLORIDA STATUTES, AS AMENDED, RELATED TO THE PROPOSED MILLAGE FOR THE CITY OF MIAMI BEACH TAX YEAR 1983; SETTING FIRST AND SECOND PUBLIC HEARINGS ON PROPOSED MILLAGE AND BUDGET. WHEREAS, the "Trim" Bill adopted by the Florida legislature has significantly altered the manner in which a municipality adopts an annual budget and tax millage; and WHEREAS, such bill outlines the steps to be fol- lowed by municipalities in this process, as more specifically described in Commission Memorandum No. 495-82 attached hereto and made a part hereof by reference; and WHEREAS, the City Commission of the City of Miami Beach, Florida, has considered the steps outlined to be fol- lowed; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the following recommendations of the Administration, be and they are hereby ratified for transmission to the Dade County Property Appraiser as specified in Sec. 200.069, Florida Statutes, as amended: Roll Back Millage for Current Year General Operating 7.24 mills Debt Service 2.12 mills Proposed Millage for FY 1982-1983 - Including Crime Control Including Without Sales Tax Sales Tax General Operating 7.48 mills 8.33 mills Debt Service 2.17 mills 2.17 mills BE IT FURTHER RESOLVED that the first Public Hearing on the Proposed Millage and Budget for FY 1982-1983 will be held on September 1, 1982, at 5:00 p.m. in the Commission Chambers, City Hall, 1700 Convention Center Drive, Miami Beach Florida, and the second hearing on September 14, 1982, at the same time and place as the first hearing. Park'ns fib City Manager SUBJECT: PROPOSED MILLAGE 1982-1983 The "Trim" Bill specifies the manner in which a municipality adopts its annual budget and tax millage. It is necessary that as a first step in the process the Commission ratify a proposed millage for FY 1982-1983 and fix the date, time and place of the first and second Budget Hearings. The proposed rate and hearing information must be in the hands of the Dade County Property Appraiser by 5:00 p.m. on July 29, 1982. The Proposed Millage will be shown on the Notice of Assessed Valuations to be sent to each property owner on August 13, 1982. The Proposed Millage is a tentative estimate and may be revised downward or left alone at either the first or second public hearings. The result of the first hearing will be the adoption of a Tentative Millage and at the conclusion of the second hearing a Final Millage will be adopted. Should the Commission wish to increase the millage, it may only do so provided that the County Appraiser has renoti- fied each property owner. The cost of the second notification must be borne by the City. A further restriction involves the setting of the date for the first hearing. It may not be held before August 30 and must be held after 5:00 p.m. The hearing must not be in conflict with other taxing authorities' budget hearings. Dade County will hold its hearings on September 9 and 16 and the School Board will hold its hearings on July 21 and September 8. A roll-back calculation must also be provided showing the effect that the 1982-1983 appraised values would have had on the 1981- 1982 tax levy. This year changes in the law mandate that the City cannot exceed the roll-back millage except for an amount equal to 30.148% of the anticipated share of the one cent sales tax. This sum must be designated for crime control. Another calculation must show the effect of the additional sales tax on the millage. ADMINISTRATION RECOMMENDATION The Administration recommends that the following information be ratified for transmittal to the Dade County Property Appraiser as specified in 200.069 of the Florida Statutes as amended.
