Resolution 82-17089 nn 6K tc -a�1 RESOLUTION NO. 82-17089 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, PROVIDING FOR THE HOLDING OF A SPECIAL ELECTION ON NOVEMBER 2 , 1982 AT WHICH THERE WILL BE SUBMITTED TO THE VOTE OF THE ELECTORATE THE QUESTION OF THE ISSUANCE OF BONDS OF SAID CITY TO FINANCE IMPROVEMENTS TO THE 21ST STREET COMMUNITY CENTER AND CONSTRUCTION OF THE COLLINS CANAL/22ND STREET WALKWAY WHEREAS, the City Commission of the City of Miami Beach, Florida (the "City" ) , deems it advisable and in the best interest of the City to issue general obligation bonds of said City in the amount and for the municipal purposes set forth below; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: Section 1. Special Election. That a Special Election of the duly registered and qualified voters residing in the City is hereby called to be held on the 2nd day of November , 1982, from 7 : 00 A.M. until 7 : 00 P.M. , to determine whether or not the issuance of general obligation bonds of the City aggregating not more than Two Million Dollars ($2, 000 , 000 . 00) (the "Bonds" ) shall be approved by such qualified electors . The Bonds shall be payable from ad valorem taxes levied on all taxable property in the City without limit as to rate or amount, the full faith and credit of the City to be pledged to the payment of principal and interest thereon. The Bonds shall bear interest at such rate or rates as may be determined at the time of the sale thereof, not exceeding the maximum legal rate of interest at such time. The purpose of the Bonds shall be to finance improvements to the 21st Street Community Center , including, among other things , renovations to the existing building , construction of a new building and related parking facilities , and construction of the Collins Canal/22nd Street Walkway from Meridian Avenue to 22nd Street along the Collins Canal and eastward along 22nd Street to the City' s Beach Front Park and Promenade. SECTION 2. Election Officials and Canvassing . That the -1- appropriate and proper Dade County election officials shall conduct the said Special Election hereby called, except for the canvassing of the returns of said Special Election, which duty shall be performed by the City Commission. The official returns for each precinct shall be furnished to the City Clerk of the City of Miami Beach as soon as the ballots from all precincts have been tabulated on the night of said Special Election. The official certification of the results of said Special Election shall be made by the City Commission of the City of Miami Beach. SECTION 3 . Polling Places. That the said voting precincts in the City for said Special Election shall be as established by the proper and appropriate Dade County election officials. All electors shall vote at the polling places in the voting precincts in which the official registration books show that the said electors reside. Registration of persons desiring to vote in said Special Election shall be in accordance with the general laws of the State governing voter registration. SECTION 4 . Notice of Election. Notice of Election shall be substantially in the following form: CITY OF MIAMI BEACH, FLORIDA NOTICE OF SPECIAL ELECTION Notice is hereby given that a Special Election has been called by the City Commission of the City of Miami Beach, Florida, and will be held in said City from 7 : 00 o'clock a.m. until 7 : 00 o'clock p.m. , on the 2nd day of November , 1982, at which time there shall be submitted to the duly registered and qualified voters of the City of Miami Beach the following question: -2- T QUESTION 2: IMPROVEMENTS TO 21ST STREET COMMUNITY CENTER AND CONSTRUCTION OF COLLINS CANAL/22ND STREET WALKWAY Shall the City of Miami Beach issue general obligation bonds in an amount not to exceed Two Million Dollars ($2, 000, 000 . 00) , bearing interest at a rate or rates as may be determined at the time of the sale thereof, not exceeding the maximum legal rate of interest at such time, to finance improvements to the 21st Street Community Center and construction of the Collins Canal/22nd Street Walkway? YES NO Said Notice shall further set forth the several polling places in the election precincts as established in accordance herewith, and shall further set forth pertinent information regarding eligibility of electors to participate in said election. SECTION 5 . FORM OF BALLOT. The form of ballot to be used in the bond election shall be in substantially the following form: "OFFICIAL BALLOT" CITY OF MIAMI BEACH, FLORIDA BOND ELECTION - NOVEMBER 2 , 1982 SHALL THE FOLLOWING QUESTION BE APPROVED OR REJECTED? QUESTION 2 IMPROVEMENTS TO 21ST STREET COMMUNITY CENTER AND CONSTRUCTION OF COLLINS CANAL/22ND STREET WALKWAY Shall the City of Miami Beach issue general obligation bonds in an amount not to exceed Two Million Dollars ($2 ,000, 000) , bearing interest at a rate or rates as may be determined at the time of the sale thereof, not exceeding the maximum legal rate of interest at such time, to finance improvements to the 21st Street Community Center and construction of the Collins Canal/22nd Street Walkway? YES • NO SECTION 6. ELECTION RESULTS. That for the purpose of determining the results of the special election, the question -3- shall be approved if a majority of the votes cast in the Special Election shall indicate approval of the question. SECTION 7 . Notice of Election. That this resolution shall be available in the Office of the City Clerk. The City Clerk shall publish Notice of Election as provided in this resolution in the Miami Beach Sun Reporter , a newspaper of general circulation in the City of Miami Beach, once a week for the four (4) consecutive weeks preceding the date of the election, in accordance with Section 10-5 of the Miami Beach Code, as well as once in the fifth week prior to the election, • pursuant to Section 100 . 342 of the Florida Statutes. SECTION 8. Absentee Ballots. That absentee voters participating in said Special Election shall be entitled to cast their ballots in accordance with the provisions of the laws of the State of Florida with respect to absentee voting. SECTION 9 . Expenses of Election. That the City of Miami Beach shall pay its proportionate share of the expenses for conducting this Special Election and will pay same to Dade County or directly to all persons or firms , upon receipt of invoices or statements approved by the Supervisor of Elections of Dade County, Florida. SECTION 10 . That the law firm of MORGAN, LEWIS & BOCKIUS of Miami and Philadelphia is hereby approved to serve as bond counsel for the City of Miami Beach in connection with the proposed bond offering. SECTION 11 . That DEAN WITTER REYNOLDS, INC. , is hereby designated to serve as financial consultant for the City for the purpose of rendering the usual and customary services of financial consultants in the marketing of the bonds and obligations hereinabove described. SECTION 12. Severability. That in the event that any word, phrase, clause, sentence, or paragraph hereof shall be held invalid by any court of competent jurisdiction, such holding -4- shall not affect. any other word, clause, phrase, sentence, or paragraph thereof. SECTION 13. Repeal of Prior Resolutions. That all resolutions or parts of resolutions in conflict or inconsistent herewith hereby are repealed, insofar as there is any conflict or inconsistency. SECTION 14. Effective Date. That this resolution shall . be effective immediately upon its passage. PASSED and ADOPTED this 18th day of August 1982.
