A RESOLUTION OF TI3E CITY COUNCIL
OF THE CITY OF I BEACH, FLORIDA,
VACATING A PORTION OF FIFTEENTH
STREET LYING IMMEDIATELY NORTH OF
THE WESTERLY PORTION OF LOT 2, IN
BLOCK 75 OF PINE RIDGE SUBDIVISION,
ACCORDING TO THE PLAT THEREOF RE_
CORDED IN PLAT BOOK 6 AT PAGE 34,
PUBLIC RECORDS OF DADE COUNTY, FLORI_
DA, AND GRANTING SUCH VACATED PORTION
THEREOF TO THE OWNER OF RECORD, HIS
HEIRS OR ASSIGNS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
Section 1: That that portion of Fifteenth Street, at present
encroached upon by a building along the northerly
line of the westerly portion of Lot 2, in Block
75 of Pine Ridge Subdivision, and as shown on the attached sur-
vey sketch prepared by Zurwelle & Whitaker, Registered Engineers,
a copy of which is made a part hereof and attached hereto, be
and the same is hereby vacated and the use of said vacated por-
tion of said Fifteenth Street be and the same is hereby granted
to the owner of record of the above described property on the
date of the passage of this resolution, his heirs and assigns,
subject to the proviso hereinafter contained.
PROVIDED, HOWEVER, that if the building now on
said premises and covering the above described land is ever moved,
demolished, destroyed by fire or rebuilt, then the above vacation
of said portion of said Fifteenth Street and the grant of the
use of the same shall be immediately revoked, terminated and ab-
solutely voided without any action on the part of the City Council
of the City of Miami Beach, Florida, and said lands above describ-
ed shall again become a portion of said Fifteenth Street for the
public use.
