RESOLUTION NO. 4136
WHEREAS, the CITY OF MIAMI BEACH WATER DEPARTMENT has
' at the expense of The Sunset Islands Company, installed permanent
water mains on Island No. 4 of Sunset Islands, as per second
revised plat recorded in Plat Book 34 at Page 73 thereof of the
Public Records of Dade County, Florida, and
WHER.EAAS, the said The Sunset Islands Company has paid
to the City of Miami Beach the said cost thereof in the amount of
Four Thousand Eight Hundred Twenty Three Dollars & Two Cents
( $4, 823.02), and
WHEREAS, it has been heretofore agreed by and between
the said City of Miami Beach and The Sunset Islands Company that
said cost shall be refunded to said The Sunset Islands Company in
the manner as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Miami Beach that said City refund to the said The Sunset
Islands Company the said cost of installation in the sum of
$4, 823.02 in two equal annual installments, the first of which
installments shall be paid one year from the time the ordinary
annual revenue to said City from said installation derived from
ordinary household use equals at least fifteen (15%) percent of the
total cost thereof and that the City Manager and the City Clerk be
and they are hereby authorized and directed to make payment of the
said sum to The Sunset Islands Company on account of said refund
in accordance with the terms of this resolution.
