Resolution 4162 RESOLUTION NO. 4162
WHEREAS, Mr. H. A. Clark proposes to make a sand fill
and construct steel sheet piling and timber bulkhead connect-
ing the seaward end of two existing groins fronting Lots 21-I
and 21-J, Block 1, 2nd Ocean Front Subdivision in the City of
Miami Beach, Florida, as shown on two drawings designated Sheet
1 of 2 and Sheet 2 of 2, respectively, and entitled:
"SKETCH TO ACCOMPANY APPLICATION FOR A
PERMIT TO CONSTRUCT A STEEL SHEET PILING
AND TIMBER BULKHEAD, FRONTING LOTS 21-I
AND 21-J, BLK. 1, 2ND OCEAN FRONT SUBD.
MIAMI BEACH, FLORIDA, FOR HAROLD A. CLARK,
MIAMI BEACH, FLORIDA. AUGUST DeWINKLER,
CIVIL ENGINEER, 925 LINCOLN ROAD, MIAMI
BEACH, FLORIDA. OCT. 4, 1937. "
and,
WHEREAS, said plans have been presented to and. considered
by the City Council, and
WHEREAS, the said City Council considers the proposed con-
struction detrimental to the public interest in that it will not
only interfere with navigation, the bulkhead, as contemplated,
to be out in six or seven feet of water, but it also establishes
a bad precedent in that the public would be estopped from the
free access to . and use of , the beach between high and low tide
over this property,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, in legal meeting assembled, that the
said City Council does hereby strenuously object to said proposed
construction for the reasons above stated, and urges the United
States Engineers Office of the War Department to deny the permit
for said project.
