Resolution 4174 RESOLUTION NO. 4174 WHEREAS, an Act entitled: "AN ACT CREATING A CIVIL SERVICE SYSTEM FOR CERTAIN OFFICERS AND EMPLOYEES OF THE CITY OF MIAMI BEACH, FLORIDA; CREAT- ING A DEPARTMENT OF PERSONNEL, DEFINING ITS MEMBERSHIP, POWERS AND DUTIES; DESIG- NATIN G THE OFFICERS AND EMPLOYEES WHO ARE WITHIN THE TERMS OF SAID ACT ; DEFINING THE CERTAIN TERMS OF SAID ACT; PROVIDING FOR APPOINTMENTS, PROMOTIONS, SUSPENSIONS, REDUCTIONS AND REMOVALS OF OFFICERS AND EMPLOYEES; PROVIDING FOR THE STATUS OF OFFICERS AND EMPLOYEES HOLDING POSITIONS WHEN THIS ACT TAKES EFFECT ; PROVIDING FOR A REFERENDUM WHEN SAID ACT SHALL TAKE EF- FECT AND OTHER MATTERS RELATING THERETO . " was passed and adopted by the Legislature of the State of Florida, at its 1937 Session and became a law, subject to referendum, and WHEREAS, Section 16 of said Act provides that said Act shall not become effective until a majority of the qualified voters of the City of Miami Beach, Florida, voting on the same at a special or general election called for such purpose, shall vote in favor thereof, and WHEREAS, pursuant to the provisions of an Act passed and adopted by the Legislature of the State of Florida, at its 1937 Session, and entitled "AN ACT TO AUTHORIZE THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, TO ESTAB- LISH BY ORDINANCE A PENSION, ANNUITY AND RETIREMENT SYSTEM FOR ANY OR ALL GROUPS OF OFFICERS AND EMPLOYEES IN THE SERVICE OF SAID CITY; TO PROVIDE FOR DISABILITY AND DEATH BENEFITS; TO PROVIDE FOR CONTRIBUTION TO THE COSTS THEREOF ON AN ACTUARIAL BASIS ; PROVIDING FOR THE MANNER IN WHICH OFFICERS- AND/OR EMPLOYEES MAY COME UNDER THE OPERA- TION OF SAID SYSTEM; PROVIDING •FOR REPAYMENT TO MEMBERS LEAVING THE SERVICE OF THE .CITY; PROVIDING FOR THE INVESTMENT OF FUNDS CREAT- ED UNDER SAID SYSTEM; PROVIDING FOR THE AD- MINISTRATION OF SAID SYSTEM; AND PROVIDING FOR THE SUBMISSION OF SAID ORDINANCE TO RE- FERENDUM OF QU+LIFIED VOTERS OF SAID CITY; WHEN SAID ACT SHALL TAKE EFFECT AND OTHER MATTERS RELATING THERETO. " the City Council of the City of Miami- Beach, Florida, did on December 3rd, 1937, pass and adopt Ordinance No. 498, entitled : "AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING A PENSION, ANNUITY AND RETIREMENT SYSTEM FOR EMPLOYEES IN THE SERVICE OF THE SAID CITY OF MIAMI BEACH; PROVIDING FOR DISABILITY AND DEATH BENEFITS; PROVIDING FOR CONTRIBUTION TO THE COST THERE- OF ON AN ACTUARIAL BASIS; PROVIDING FOR THE MANNER IN WHICH EMPLOYEES MAY COME UNDER THE OPERATION OF SAID SYSTEM; PROVIDING FOR RE- PAYMENT TO MEMBERS LEAVING THE SERVICE OF SAID CITY; PROVIDING FOR THE INVESTMENT OF FUNDS CREATED UNDER SAID SYSTEM; PROVIDING FOR THE ADMINIST RAT ION AND OPERATION OF SAID SYSTEM •AND PROVIDING FOR THE SUBMISSION OF THIS ORDINANCE TO A REFERENDUM OF QUALIFIED VOTERS OF SAID CITY; PROVIDING WHEN THIS ORDINANCE SHALL TAKE EFFECT, AND OTHER MATTERS RELATING THERETO" and WHEREAS, Section 12 of said Ordinance No. 498 provides that said ordinance shall not become effective until a majority of the qualified voters of said City of Miami Beach, Florida, voting on the same at a special or general election called for such purpose, shall vote in favor thereof, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: Section 1: That a Special Election be and thr same is hereby called to be held at the City Hall, in the City of Miami Beach, Florida, from 8:00 o'clock A. M. , until sundown on January 18th, 1938, for the pur- pose of giving the qualified voters of said City an opportunity to vote for or against that certain Act of the Legislature of the State of Florida, entitled: "AN ACT CREATING A CIVIL SERVICE SYSTEM FOR CERTAIN OFFICERS AND EMPLOYEES OF THE CITY OF MIAMI BEACH, FLORIDA; CREATING A DEPART- MENT OF PERSONNEL, DEFINING ITS MEMBERSHIP, POWr,?S AND DUTIES; DESIGNATING THE OFFICERS AND EMPLOYEES 'VHO ARE WITHIN THE TERMS OF SAID ACT; DEFINING THE CERTAIN TERMS OF SAID ACT; PROVIDING FOR APPOINTMENTS, PROMOTIONS, SUSPENSIONS, REDUCTIONS AND REMOVALS OF OFIC- ERS AND EMPLOYEES; PROVIDING FOR THE STATUS OF OFFICERS AND EMPLOYEES HOLDING POSITIONS iiHEN THIS ACT TAKES EFFECT; PROVIDING FOR A REFERENDUM WHEN SAID ACT SHALL TAKE EFFECT AND OTHER MATTERS RELATING THERETO" becoming effective, and for the purpose of giving the qualified voters of said City an opportunity to vote for or against Ordinance No. 498, as passed and adopted by the City Council of the City of Miami Beach, Florina , said Ordinance being entitled: "AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING A PENSION , ANNUITY AND RET IRE M ENT T SYSTEM FOR EMPLOYEES IN THE SERVICE OF THE SAID CITY OF MIAL I BEACH; PROVIDING FOR DISABILITY AND DEATH BENEFITS; PROVIDING FOR CONTRIBUTION TO THE COST THERE- OF ON AN ACTUARIAL BASIS; PROVIDING FOR THE MANNER IN WHICH EMPLOYEES LAY COME UNDER THE OPERATION OF SAID SYSTEM; PROVIDING FOR RE- PAYMENT TO MEMBERS LEAVING THE SERVICE OF SAID CITY; PROVIDING FOR THE INVESTMENT OF FUNDS CREATED UNDER SAID SYSTEM; PROVIDING FOR THE ADMINISTRATION AND OPERATION OF SAID SYSTEM AND PROVIDING FOR THE SUBMISSION OF THIS ORDINANCE TO A REFERENDUM OF QUALIFIED VOTERS OF SAID CITY; PKVIDING WHEN THIS OR- DINANCE SHALL TAKE EFFECT, AND OTHER MATTERS RELATING THERETO, " becoming effective. Section 2: That for the purpose of holding and conducting said ficial Election to be held on January 18th, 1938, an election board be provided and that for said purpose inspectors and clerks be and the same are hereby appointed as follows : Clerks : R. J. Wallis Sam R. Becker Inspectors : W. M. Fiske Adams John M. Ramey M. J. Eanett Ralston Van Tassell Kathryn Kelsey J. Russell West all of which names the City Clerk shall certify to the Mayor. -3- Section 3: That notice of said election shall be given by the Mayor of said City by posting, or causing to be posted, the notice herein- after provided, for a period of thirty days, in three conspicuous places in the City of Miami Beach, to-wit: At the Police Station, corner of First Street and Meridian Avenue; at the Liberty Avenue Fire Station, 2327 Liberty Avenue; and at the City Hall; and the same shall be published once a week for a period of four (4) con- secutive weeks next preceding such election, in the Miami Beach Times, a newspaper published in the City of Miami Beach, Florida. Section 4: That said inspectors and clerks shall certify the result of said election to said City Council immediately after the holding of said election. in Section 5: That Notice of Election shall be /substantially the following form: "NOTICE OF ELECTION Notice is hereby given that a Special Election will be held at the City Hell, in the City of Miami Beach, Florida, from 8.00 o' clock A. u . , until sundown, on January 18th, 1938, for the purpose of giving the qualified voters of said City an opportunity to vote for or against a certain Act of the Legislature of the State of Florida, becsbming effective; said Act being entitled: "AN ACT CREATING A CIVIL SERVICE SYSTEM FOR CERTAIN OFFICERS AND EMPLOYEES OF THE CITY OF MIAMI BEACH, FLORIDA; CREATING A DEPART- MENT CF PERSONNEL, DEFINING ITS MEMBERSHIP, POWERS AND DUTIES; DESIGNATING THE OFFICERS AND EPLOYEES WHO ARE WITHIN THE TERMS OF SAID ACT; DEFINING THE CERTAIN TERMS OF SAID ACT; PROVIDING FOR APPOINTMENTS, PROMOTIONS, SUSPENSIONS, REDUCTIONS AND REMOVALS OF OFFI- CERS AND EMPLOYEES; PROVIDING FOR THE STATUS OF OFFICERS AND EMPLOYEES HOLDING POSITIONS WHEN THIS ACT TAKES EFFECT; PROVIDING FOR A REFERENDUM WHEN SAID ACT SHALL TAKE EFFECT AND OTHER MATTERS RELATING THERETO" , and for the purpose of giving the qualified voters of said City an opportunity to vote for or against Ordinance No. 498 of the City Council of said City, becoming effective; said Ordinance being entitled: "AN ORDINANCE OF THE CITY OF MIAMI B:tACH,FLORIDA, ESTABLISHING A PENSION, ANNUITY AND RETIREMENT SYSTEM FOR EMPLOYEES IN THE SERVICE OF THE SAID CITY OF I` IAMI BEACH; PROVIDING FOR DISABILITY AND DEATH BENEFITS; PROVIDING FOR CONTRIBUTION TO THE COST THEREOF ON AN ACTUARIAL BASIS; PRO- VIDING FOR THE MANNER IN WHICH EMPLOYEES MAY COME UNDER THEOPERATION OF SAID SYSTEM; PROVID- ING FOR RE-PAYMENT TO MEMBERS LEAVING THE SERVICE OF SAID CITY; PROVIDING FOR THE INVESTMENT OF FUNDS CREATED UNDER SAID cYSTEM; PROVIDING FOR THE ADI,'INISTRATION AND OPERATION OF SAID SYSTEM AND PROVIDING FOR THE SUBMISSION OF THIS ORDI- NANCE TO A REFERENDUM OF QUALIFIED VOTERS OF SAID CITY; PROVIDING WHEN THIS ORDINANCE SHALL TAKE EFFECT, AND OTHER MATTERS RELATING THERETO" Inspectors and. Russell Hest The registration books of said City will be open for the purpose of registering any person (not already registered) qualified to vot in such election until and including December lath, 1937. e -4- All persons still on the City Registration Books who were properly registered and qualified to vote in the last General City Election, held June 1st, 1937, are eligible to vote in this election.
