Resolution 4857 RESOLUTION NO. 4857
WHEREAS, this body has been petitioned by Robert Pentland,Jr. ,
sole trustee, of Lot One (1) , Block One (1) , and outlot of Amended
Plat of Fleetwood Subdivision, as recorded in Plat Book Twenty-eight
(28) , Page Thirty-four (34) , of the Public Records of Dade County,
Florida, to release and relinquish any and all rights or interest
the City may have in the southerly five ( 5 ) feet of said Lot One (1) ,
1 by reason of that certain instrument of easement executed by Fle-twood.
Hotel Corporation
under date of April 13, 1925, and filed for record under date of
May 26, 1925, in Deed Book Six hundred fifty-eight ( 658) , Page Eleven
( 11) , of the public records of Dade County, Florida; and
WHEREAS, Robert Pentland, Jr. , now offers to give to the City
of Miami Beach in exchange for said release or relinquishment a new
easement ten (10) feet in width across said outlot,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk be, and they
are hereby authorized to execute a quit-claim deed to the said
Robert Pentland, Jr. , on behalf of the City of Miami Beach as to the
southerly five ( 5) feet of said Lot One (1) , Block One (1) , Amended
Plat of Fleetwood Subdivision, in accordance withsaid petition as
noted above, and upon receipt of the new easement across said. outlot.
