A RESOLUTION PERMITTING FLORIDA POWER
& LIGHT COMPANY, OR ITS SUCCESSOR, TO
STORE ON CAUSEWAY ISLAND, FOR USE AT
ITS PUBLIC UTILITY PLANT LOCATED ON
SAID ISLAND, AND NOT FOR RESALE, CER-
TAIN QUANTITIES OF FUEL OIL, IN TWO
ADDITIONAL TANKS, UNDER CERTAIN CON_
DITIONS AND UNDER CERTAIN RESTRICTIONS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
1. That Florida Power & Light Company, or its successor, is
hereby authorized to store on Causeway Island, for use at
its public utility plant located on said Causeway Island, and not
for resale , Bunker C or other similar fuel oil in two tanks in
addition to its present storage tanks, the aggregate capacities of
both of which shall not exceed 12,000 barrels and which tanks shall
be built and installed in accordance with standard engineering
practice with respect to safety and construction.
2. That in the event litigation shall arise at any time in
the future between the City of Miami Beach on the one part
and The Texas Company, Sun Oil Company and Gulf Oil Corporation, or
any of them, on the other, whereby the City shall seek to cause
all or any of said companies to remove their storage tanks or plants
from their present location, and if any of said companies shall
take advantage of (1) the permission of the City to Florida Power &
Light Company to install the said s.dditional tanks or ( 2) the presence
of such tanks on the premises of Florida Power & Light Company con-
taining Bunker C fuel oil or a similar oil so as to prejudice the
Cityts case, then the City reserves the right to require the said
Florida Power & Light Company to forthwith remove the said two
additional tanks referred to in the first paragraph of this Resolution.
3. That Florida Power & Light Company, by commencing the in-
stallation of the two additional tanks, after the passage
of this Resolution, thereby evidences its consent to this Resolution,
and each and every part hereof.
4. That this Resolution shall take effect upon its passage
and adoption.
