Resolution 5280 RESOLUTION NO. 5280
WHEREAS, this body has been petitioned by Balfour Invest-
ments, Inc. , owners of Lot 1 of a Resubdivision of Lots 1 and 2,
Block 32, Lake View Subdivision, as per Plat Recorded in Plat
Book 38, at Page 64 of the Public Records of Dade County, Florida,
to release and relinquish any and all rights or interests the City
may have in the ten foot easement near the center of said Lot 1,
shown on said Plat of a Resubdivision of Lots 1 and 2, Block 32,
Lake View Subdivision, and
WHEREAS, Balfour Investments, Inc. , the owners of said Lot 1,
now offer to give to the City of Miami Beach in exchange for said
release or relinquishment, a new easement five ( 5) feet in width
along the easterly side of the said lot, the easterly side of said
easement being the easterly line of said Lot 1, and title to said
Lot 1 being duly vested in said owners .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF bMIA! I BEACH, FLORIDA, that the Mayor and City Clerk be,
and they are hereby authorized to execute a quit claim deed to
the said Balfour Investments, Inc. , on behalf of the City of I,:iami
Beach, as to the ten foot easement through Lot 1, of the Resubdivision
of Lots 1 and 2, Block 32, of said Lake View Subdivision, in accord-
ance with said petition as noted above, and upon receipt of the new
easement across said Lot 1 as above described.
