Resolution 5341 RESOLUTION NO. 5341
WHEREAS, the City Council of the City of Miami Beach, Florida,
have been petitioned to consider the amending, supplementing,
changing, modifying and/or repealing of the regulations, restrictions,
and/or boundaries as provided in Ordinance No. 289, commonly known
as the Zoning Ordinance of Miami Beach, Florida, as hereinafter set
forth, to-wit :
That the Sub-section (9) of Section 15 of Ordinance No. 289
of the City of Miami Beach, Florida, be amended so as to read
as follows :
(9) "BAAA", "BAA", "BA", "BB", "BC", "BD", "BE", "BF",
and "BG", Business Districts :
( a) In all business districts, buildings erected
for dwelling purposes shall comply with the
lot area and floor area per family regula-
tions prescribed for the "RE" Multiple-
Family District.
(b) There shall be provided adjacent to multiple
or single family occupancies located in Business
Districts, a side yard open on at least one end
to either a street or alley and unobstructed to
the sky, except as otherwise provided in the
Zoning Ordinance, and not less than five (5)
feet in width, extending full width not less
than sixty (60) percent of the lot depth; pro-
vided, however, that where inner courts not less
than ten (10) feet in clear width and open full
width on at least one end to a street or alley
are provided, such side yard requirements shall
not apply.
( c) Where buildings for business occupancy are set
back from interior lot lines, such set-back
shall in no case be less than twenty-eight (28)
inches and it shall be continuous on at least
one end to a street or alley.
NOW, THEREFORE, BE IT RESOLVED that a public hearing be called
for the 3rd day of September, 1941, at 10:00 o' clock A. M. , in the
Council Chambers at the City Hall, Miami Beach, Fiorlda, for the purpose
as above set forth, and
BE IT FURTHER RESOLVED, that notice of the time, place and object
of such hearing be published as is provided by said Ordinance.
