RESOLUTION NO. 5359
WHEREAS, it appears from a survey and blue-print made by
Richard F. Giersch, Jr. , Registered Engineer and Land Surveyor, on
August 25th, 1941, that a certain part of the building known as
the Cambridge Hotel, No. 330 Michigan Avenue, in the City of Miami
Beach, Florida, situated on Lots 4, 5 and 6, Block 100, Ocean Beach
Addition No. 3, according to plat thereof recorded in Plat Book 2,
at Page 81, of the Public Records of Dade County, Florida, encroaches
upon and overhangs that part of the alley running in a northerly and
southerly direction through Block 100, of said Ocean Beach Addition
No. 3, west of Lots 4 and 5, and a certain part of said building
encroaches upon and overhangs Michigan Avenue, east of Lots 4 and 5,
as shown on said survey and blue-print prepared by Richard F. Giersch,
Jr. , Registered Engineer and Land Surveyor, a copy of which is attached
hereto and made a part hereof, and
WHEREAS, it further appears that said encroachments and overhangs
do not materially affect and interfere with the use of said alley and
said Avenue;
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA, that the aforesaid encroachments and overhangs be
allowed to remain for and during the life of said building.
