A RESOLUTION APPROVING, rNDORSIvG AND ADOPT-
ING A PLAN DEVELOPED BY THE PLANNING BOARD
OF THE CITY OF MIAMI, RELATING TO THE
DESIGNATION OF A SITE FOR THE LOCATION OF
NEW PASSENGER AND FREIGHT STATIONS AND FACILITIES
TO BE CONSTRUCTED, ESTABLISHED, OPERATED AND
MAINTAINED IN THE CITY OF MIAMI, FLORIDA, BY
THE FLORIDA EAST COAST RAILWAY; DIRECTING
THE CITY MANAGER AND THE CITY ATTORNEY OF
MIAMI BEACH, FLORIDA, TO TAKE ALL NECESSARY
ACTION TO EXPEDITE THE COMPLETION OF PROCEED-
INGS BEFORE THE RAILROAD COMivISSION OF THE
STATE OF FLORIDA AS MAY BE 1) U EXPEDIENT EY
THE CITY MANAGER OF THE CITY OF MIAMI BEACH,
FLORIDA , TO EFFECT THE CONSTRUCTION OF SAID
STATION BlILDINGS AND FACILITIES, AND INCLUDING
THE ABANDONMENT OF CERTAIN EXISTING LINES; AND
DIRECTING Tri: CITY CLERK OF THE CITY OF MIAMI
BEACH, FLORIDA, TO SEND A COPY OF THIS RESOLUTION
TO EACH MEMBER AND TO THE SECRETARY OF SAID
RAILROAD COMMISSION AND TO OTHER CITIES AND TOWNS
IN DADE COUNTY, FLORIDA:
WHEREAS, the existing passenger and freight station
buildings and facilities of the Florida East Coast Railway for
the comfort, convenience and accomodation of the public in the
Greater Miami area are and have been during the past several
years grossly inadequate with respect to their location, design,
size and equipment , and
WHEREAS, the City of Miami, Florida, in October,
1937, initiated proceedings before the Railroad Commission
of the State of Florida to compel the Florida East Coast Railway
Company to construct, establish, operate and maintain modern
and adequate passenger station buildings and facilities in
Miami, Florida, on a site removed from the congested business
area of said City, and
WnEfiEAS, the Railroad Commission has held two
public hearings in the furtherance of said proceedings, and it
is now fitting and timely for the City of Miami Beach, Florida,
to indicate to the Railroad Commission the preference of this
said City, and of its citizens, with respect to the location,
scope and design of such facilities as the Railroad. Commission
may require the Florida East Coast Railway Company to construct,
establish, operate and maintain, and
WHEREAS, the City Commission of the City of Miami,
Florida, on June 24, 1940, by its Resolution No. 16296 instructed
the City Planning Board of said City to hold advertised public
meetings and to make recommendations as to a new location for a
new Florida East Coast Railway Station and Terminal, and to sub-
mit its findings to the City Commission of the City of Miami,
Florida, and
WHEREAS, the City Planning Board of the said City
of Miami , Florida, did over a period of months hold such
advertised meetings, fourteen (14) in number, and did enlist
the opinions of the various civic boards, engineering societies
and individuals, and as a result of said hearings and in obed-
ience to said Resolution, and in consideNation of the plans of
the said Board with reference to municipal planning in the City
of Miami, Florida, and in accordance with the duties imposed
upon the Board by the Legislature of the State of Florida in
the creation of said. Board, did establish an area for the location
of new passenger, freight and express facilities for the Florida
East Coast Railway within an area beginning with the junction
of Northwest Seventh Avenue and Northwest Fourteenth Street on
the south, extending eastward along the North line of Northwest
Fourteenth Street to Northwest Miami Court on the east, extending
northward along the west line of Northwest Miami Court to North-
west Sixteenth Street, thence westerly along the south line of
Northwest Sixteenth Street to the east line of Northwest First
Court, thence northerly along the east line of Northwest First
Court to the north line of Northwest Twenty-first Street, thence
easterly along the north line of Northwest Twenty-first Street
to the east line of Northwest First Avenue, thence northerly
along the east line of Northwest First Avenue to Northwest
Twenty-second. Street, thence easterly along tie south line of
Northwest Twenty-second Street, extending to the present right-
of-way of the Florida East Coast Railway; thence northeasterly
along the said right-of-way to a point opposite the south line
of Northwest Twenty-third. Street, thence due westerly from said
right-of-way along the south line of Northwest Twenty-third
Street projected to the east line of Northwest Seventh Avenue,
thence due south along the saideast` line to the point cf
beginning, same being generally known and described as the
"14th Street Location" ,and
VinEREAS, the City Planning Board of the City of
Miami, Florida, in further study of a location for a new
passenger, freight and express terminal facilities of the
Florida East Coast Railway within said area, did prepare and
make a plan of the area to be included in the re-location
of such facilities and erection of the necessary buildings,
tracks, stations and sheds within the said area and did make
and prepare a plan or plat, dated November 10, 1941, covering
properties which in the opinion of the rlanning Board of the
City of Miami, Florida, and in the opinion of the City Council
of the City of Miami Beach, Florida, arenecessary and expedient
for the Florida East Coast Railway to acquire for the purpose
of re-location of said facilities, and which property was found
to have an assessed valuation of 648,000 on a 100;* Dade County,
1941 assessment value, and
vwnEREAS, as a part and parcel of the said City
Planning Board' s report, the said Board upon said hearing,
found and determined that the existing railroad facilities of
the Florida East Coast Railway south of the tracks shown on
the plat referred to in the preceding paragraph would no
longer be necessary because of the existing Belt Line Railway
of the Florida East Coast Railway extending around the City
of Miami to the south of proposed new terminal, and because
the present existing tracks prevent the consummation of the
City of Miami plans for the handling of traffic within the City
of Miami, and because they constitute a continual menace to the
safety of the citizens of the City of Miami Beach, Florida, as
well as those of the City of Miami, Florida, by way of hazards
to property and life and by way of interruption of the flow of
vehicular traffic through the City of Miami, Florida, and to
and from the City of Miami Beach, Florida, and
WHEREAS, the said City Planning Board further
found that all parties of interest have either agreed
or admitted that the present station terminal facilities
of the Florida East Coast Railway are grossly inadequate
to service the business of that railroad within the City
of Iviiami, Florida, and that the erection of new facilities
is immediately necessary, and that in the rebuilding
it will be expedient to consolidate the passenger,
freight and express terminal facilities at a new
location in the interest of public convenience ands afety
and that the proposed 14th Street location is the most
central point from the now present center of population
and for the City of Miami Beach and other adjoining
cities at which such new station can be located, and
most desirable from tie standpoint of traffic regulation,
and
WHEREAS, the report of the City Planning Board
has been and was duly made to the City Commission of
the City of Miami, Florida, and submitted to the City
Council of the City of Miami Beach, Florida, with
the modifications and changes recited above, and
WHEREAS, the City Council of the City of Miami
Beach, Florida, has been fully advised in the premises
and has considered the above matters and the City
Council of said City, being of the opinion that the
report of the City Planning Board of the City of Miami,
Florida, modifed as above, should be adopted and that
the 14th Street location above set forth is best suited
for the location of the new terminal facilities of
the said railway, and to the needs of public convenience
and safety of the residents, inhabitants and visitors
of the City of Miami Beach, Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL 02 THE CITY OF MIAMI BEACH, FLORIDA:
Section 1: That the plan developed by the Planning
Board of the City of Miami, Florida, and adopted
by Resolution No. 606 of said Board, on December 2, 1940,
as modified, providing for the construction and establish-
ment of a naw passenger station, new freight depot and
new express facilities by the Florida East Coast on the
14th Street location described above, substantially in
compliance with the diagram of facilities indicated on a
certain plat , Exhibit "A" attached to Resolution No. 17489
of the City of Miami, Florida, be and the same is
hereby approved, endorsed and adopted.
Section 2: That the recommendation of the City
Planning Board of the City of Miami , Florida, that
the railroad facilities south of those facilities shown on
said Plat, Exhibit "A" attached to Ordinance No. 17489
of the City of Miami, Florida, extending to the southern
limits of the City of Miami, be abandoned at discontinued
upon the completion of the new facilities at the 1 4th
Street location, and that such abandonment and discontinuance
is necessary for the public convenience and safety, is
hereby endorsed, approved and adopted.
Section 3: That the City Manager and the' City
Attorney be and they are hereby directed to do
whatever the City Manager deems expedient in the premises
to expedite the purposes set forth in this Resolution,
and to aid the City of Miami and its officers in any way
deemed expedient by the City Manager of Miami Beach, Florida,
to help in securing the relief sought in the premises.
SECTION 4: That the Railroad. Commission the State
of Florida is hereby petitioned to immediately under-
take a survey of the 14th Street location and to estimate
the cost of the facilities to be located thereon, their
extent and general type and to do all things necessary to
effect a speedy termination of the application of be City
of MIAMI for the establishment of such facilities at that
location.
SECTION 5: That the City Clerk be and he is
hereby directed to send a duly authenticated copy of
this Resolution to each and every member of the Railroad
Commission of the State of Florida and to the several
cities in the County cf Dade in the State of Florida, re-
questing that said cities concur in the action of this
City Council in the recommendation of the 14th Street site.
