Every hotel that went to court over their 1961 assessments won their suits in the Circuit Court, but none of these decisions were appealed but those on the hotels which I own- Now the County Attorney is giving absolute falsehoods to the Court of Appeals and the news- papers, apparently for the purpose of damaging our reputation and business. A copy of the newspaper article I refer to, and my letter to Mr. Davis, are enclosed. Since the County Attorney has singled my properties out for special, damaging treatment, I do not feel that he will give you the facts, consequently, I must. I am enclosing, besides the copy of the letter and newspaper article, a photostatic copy of the figures the County Attorney placed in the brief to the Court of Appeals and from which he is quoting in the newspaper . You will note in the columns under Bishop, Gautier, Burke and Elcook, the words "Full Cash Value Depreciated," for each Df the hotels. In the column which states "Federal Tax Returns" you will notice that it does not say "Full Cash Value Depreciated," but merely "Federal Tax Returns." This omission and others are flagrant attempts to mislead. On the same line of the same Federal income tax returns from which the County Attorney took his figures, depreciation from there above dates up to January 1, 1961 are shown, however, these figure■ were completely ignored, therefore, the County Attorney has used depre- ciated figures in one case and non-deprecated figures in another case to suit his own purpose and then has the audacity to tell the courts and the press that we have mislead eomeone. After reading in the newspaper your quotes accusing me of giving different figures on my Federal income tax returns than those to the county, I asked my attorney to give me a copy of your brief to the Court of Appeals, in which you make these charges. Much to my amazement, I discovered that on the list of values you pre- pared and entered in this brief, on those yiven by Mr. Bishop, Mr. Gautier, Mr. Burke and Mr. Elcook, you used January 1, 1961 depreciated figures but when you came to the list of figures that were on the in- come tax returns, you used 1.958 firpures for the Deauville Hotel, 1950 t :,tures for the Casablanca hotel, 1950 figures for the Sherry Pronto- nac Hotel, 1954 tiyures for the Cornet Hotel, 1954 figures for the Crown Hotel and 1959 figures for the Coronet Hotel. So, actually, it is you who is using different figures to suit your purpose, and not us, as you have accused. I then read the entire court file and to my further amazement, I dis- covered that through questioning during the trial, you, yourself made an issue to bring out these differences in great detail, consequently, you knew you were giving misleading figures to the court and the news- papers.
