A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA,
AUTHORIZING A REDUCTION IN RENT TO
BE PAID THE CITY OF MIAMI BEACH, FLORIDA,
UNDER A LEASE COVERING LOT SEVENTEEN
( 17) OF BLOCK ONE HUNDRED AND ELEVEN
( 111) OF OCEAN BEACH ADDITION NUMBER
THREE (3) AND AUTHORIZING THE PROPER
CITY OFFICIALS TO EXECUTE THE NECESSARY
PAPERS TO EFFECT SUCH REDUCTION.
WHEREAS, the City of Miami Beach, Florida, is the owner
of Lot 17, Block 111 of Ocean Beach Addition #3, which said
property it acquired subject to a lease between the Patrician Hotel
Company, a Florida corporation, and T. A. Ybhiteside and Leonard
Beldner, doing business as Miami Beach Bowling Alleys, and
WHEREAS, the said Leonard Beldner has agreed that the
City of Miami Beach may use the West one-half (Wi) of the above-
described property for City purposes during the remaining term of
said lease in such a way as not to disturb the possession or the
business of the said Leonard Beldner located on the East portion of
said lot, and
WHEREAS, the above-described lease requires that the
said lessees pay a monthly rental in the sum of $1i75.00 during that
periodof the above-described lease, beginning on the 12th day of
September, 1940, and continuing for the remaining term of said lease,
and
WHEREAS, it seems equitable and just to the City Council
of the City of Miami Beach, Florida, that a portion of the rental
during the above-described period of time should be waived in
consideration of the agreement of Leonard Beldner above set forth;
NOW, THEREFORE, be it resolved by the City Council of
the City of Miami Beach, Florida:
SECTION 1: That the rental to be paid to the City of Miami Beach,
Florida, by T. A. Whiteside and Leonard Beldner, doing
business as Miami Beach Bowling Alleys, under a certain leasehold
agreement dated August 14 , 1937, by and between Patrician Hotel
Company, a Florida corporation, and T. A. Whiteside and Leonard
Beldner, doing business as Miami Beach Bowling Alleys, wherein and
whereby the lessees therein named wereiven the possession
Lot 17, Block 111, of Ocean Beach Addition #3, beand the same is
hereby reduced to the sum of 050.00 per month, instead of 4$75.00
per month, as provided for in said lease, the City of MiaiLi Beach,
Florida, hereby waiving the sum of 4,25.00 per month for the remaining
period of said lease.
SECTION 2: The City Attorney of the City of Miami Beach, Florida,
is hereby directed to draw a proper instrument, putting
into force and effect the intent and purport of this Resolution
and the proper City officials of the City of Miami Beach are here-
by directed to execute such instrument when so prepared by the
City Attorney.
SECTION 3: The reduction in rental, or waiver of rental herein
provided for shall be effective as of the payment
of rent falling due on the 12th day of February, A. D. , 1942.
