RESOLUTION NO. 5526
WHEREAS, the City Council of the City of Miami Beach,
Florida, have been petitioned to consider the amending, sup-
plementing, changing, modifying and/or repealing of the regu-
lations, restrictions , and/or boundaries as provided in Ordi-
nance No. 239, commonly known as the Zoning Ordinance of
Miami Beach, Florida, as hereinafter set forth, to-wit:
That that portion of Section 14 of Ordinance No. 289
of the City of Miami Beach, Florida, reading as follows :
"Whenever a non-conforming use of a building
has been discontinued for a period of one ( 1)
year or more, such non-conforming use shall
not thereafter be re-established and the future
use shall be in conformity with the provisions
of this Ordinance. "
be amended so as to read as follows :
"Whenever a non-conforming use of a building
has been discontinued for a period of one (1)
year or more, such non-conforming use shall
not thereafter be re-established, and the future
use shall be in conformity with the provisions
of this Ordinance; provided, however, that any
use of any land or buildings in which a non-
conforming use exists as hereinabove provided,
by any branch of the military service of the
United States of America, duringa state of war,
shall not be deemed, or held to be, an abandon-
ment, or discontinuance, of the non-conforming
use thus vested in said land. "
NOW, THEREFORE, BE IT RESOLVED, that a public hearing be
called for the 20th day of May, 1942, at 10:00 o' clock A. M. ,
in the Council Chambers at the City Hall, Miami Beach, rlorida,
for the purpose as abo,re set forth, and
BE IT FURTHER RESOLVED, that notice of the time, place
and object of such hearing be published as is provided by
said Ordinance.
