Resolution 5621 I RESOLUTION NO. 5621 WHEREAS, the minutes of February 18, 1942, of the Council of the City of Miami Beach, Florida, read, in part, as follows: "Mr. xuy Ellis of the Lincoln Road Association addressed the 'Jouncil, advising that the Supreme Court had sustained the ruling of the lower Courts to the effect that our Ordinance regulating the holding of auctions in "BC" Districts was unrea- sonable. he now offered the following ordinance which he hoped would be satisfactory to the Courts, but at the same time would keep such sales within certain Districts. " and WHEREAS, on or about the 1st day of July, 1942, Mr. Guy W. Ellis pointed out to Mr. C. Tomlinson, the Clerk of said Council, that I,;r. Guy W. Ellis hadnot offered the ordinance referred to in the above quoted portion of the said minutes; and WHEREAS, Yr. Guy W. Ellis thereupon requested that the minutes of February 18, 1942, of the Council of the City of Miami Beach, Florida, be corrected to state the true facts ; and WAERAS, the Council of the City of Miami Beach, Florida, (with the exception of Councilman L. L. Powell, who was not a member of the City Council on February 18, 1942) well remembers and recalls that Mr. Guy W. Ellis did not offer the ordinance referred to in the said minutes of February 18, 1942, either in his own behalf or that of any one else; NOW, ER FOR , LL 1T RESOLVED that the minutes of February 18, 1942, of the City Council of Miami Beach, Florida, be, and they are, hereby corrected to state the true facts, by striking and deleting from said minutes the following: "He now offered the following ordinance which he hoped would be satisfactory to the Courts, but at the same time would keep such sales within certain districts" and, in a new paragraph, in stead thereof, inserting the followin, : "There was thereafter presented the following ordinance which was hoped would be satisfactory to the c'ourts, but at the same time would keep auction sales within certain districts. ' BE IT FURTlizh RLSOLV f that C. W. Tomlinson, the Clerk of the said Council, Ue and he is hereby directed to cause the saidminutes of February 18, 1942, of the City of E-ami Beach, Florida, to be corrected to conform with the true facts as expressed in this resolution and that tnis resolution itself be attached to and made a part of the said minutes of . ebruary 18, 1942, as fully as though said correction had taken place on the 18th day of ebrua ry, 1942, FASSiSD and ADOPTED this 3rd day of February, A. ) . 1943. r � Mayor Attest : City Clerk If • C.)
