Resolution 5636 RESOLUTION NO. 5636 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 02 MIA s BEACH, FLORIDA, that it is deemed to the best interest of said City to secure the passao.e, at the 1943 session of the State Legislature, of a bill entitled, "AN ACT TO AUTHORIZE THE CITY OF MIAMI BEACH TO LEVY A SPECIAL TAX UPON ADMISSION TICKETS SOLD BY ANY LICENSEE OF THE FLORIDA STATE RACING CO kiSSION OF ANY RACE TRACK LOCATED 'WITHIN TE BOUNDARIES OF SAID CITY OF MIAMI BEACH; FIXING THE A OUNT OF SAID SPECIAL TAX AND IMPOSING UPON SAID LICENSEE THE BURDEN OF ADDING SAID SPECIAL SCIAL TAX TO THE AMOUNT OF EACH AND EVERY ADMISSION TICKET SOLD AND OF COLLECTING TSE SAME AND PROVIDING A PENALTY FOR THE FAILURE SO TO DO, AND PROVIDING FURTER, THAT THIS SPECIAL TAX SHALL BE IN ADDITION TO THE TAXES AUThORIZED IN SECTION 10, OF CHAPTER 14832, ACTS OF TE LEGISLATURE, LAVu3 OF FLORIDA FOR 1931, AND FOR OTHER PURPOSES." Gautier, Jr. , members of the State Legislature from Dade County, and that they each be respectfully requested to see that a bill, substantially in accordance with said copy be introduced and passed at said session. D. 1943. _ Mayor ATTEST; City Clerk A BILL TO BE ENTITLED: AN ACT TO AUTHORIZE THE CITY OF MIAMI BEACH TO LEVY A SPECIAL TAX UPON ADMiSSION TICKETS SOLD BY ANY LICENSEE OF THE, FLORIDA STATE RACING COMIAISSION OF ANY RACE TRACK LOCATED WITHIN THE BOUNDARIES OF SAID CITY OF MIAMI BEACH; FIXING THE AMOUNT OF SAID SPECIAL TAX AND IMPOSING UPON SAID LICENSEE THE BURDEN OF ADDING SAID SPECIAL TAX TO THE AMOUNT OF EACH AND EVERY ADMISSION TICKET SOLD AND OF COLLECTING THE SAME AND PROVIDING A PENALTY FOR THE FAILURE SO TO DO, AD PROVIDING FURTHER, THAT THIS SPECIAL TAX SHALL BE IN ADDITION TO THE TAXES AdTHORIZED IN SECTION 10, OF CHAPTER 14832, ACTS OF THE LEGISLATURE, LAS OF FLORIDA FOR 1931, AND FOR OTHER PURPOSES. BE IT ENACTED, BY THE LEGISLATURE OF THE STATE OF FLORIDA: SECTION 1. That the city of Miami Beach, Florida, a Municipal Corporation, is hereby authorized to levy a special tax of ten (1C ) cents upon each admission ticket sold by any licensee of the ?lorida State Racing Commission licensed to operate a race meeting which is located within the boundaries of the City of Miami Beach, Florida, upon the following conditions : (a) Provided however, that the City shall be pro- hibited from levying said special tax upon any ticket or pass issued to any official, agent, or employee of any racing association owning or operating a race twack in the City of Miami Beach, or to any representative of the press, or any owner, trainer, or any one employed by any owner or trainer, neither shall said tax be collected upon any tickst or pass issued to any person employed in any capacity upon the premises of any such licensee; said licensee shall have the right to issue free passes or tickets marked "tax paid" or "tax free" to any person provided said licensee assumes liability for the payment of the special tax provided herein. (b) 4ny licensee of the State Racing Commission, owning and operating a race track in the City of Miami Beach, is hereby re- quired to levy and collect the tax upon admissions and admission tickets provided for in this Act. (c) Any licensee of the State Racing Commission failing to assess or collect the tax aforesaid, shall be liable to the City of Miami Beach upon each admission sold to the bxtent of the tax, and upon the aggregate amount of tickets sold with exceptions hereinbe- fore designated in the aggregate amount of taxes herein provided and said licensee shall be required to make aseni-monthly accounting, of the number of tickets sold, an admissions to said race meeting, and shall, on the 1st and 16th of each month, pay to the City of Miami Beach, all taxes so assessed and collected, and at the end of each race meeting shall make a full and complete accountinz to the City of Miami Beach, and pay all balance, if any due to said City, at the time of making such final accounting. (d) Any licensee failing to assess and collect said tax and pay over the same to the City of Miami Beach as herein provided, shall be cited for hearing before the Florida State Racing Commission, and if found guilty by said Racing Commission, shall have their li- cense to conduct race meetings cancelled, until such time as said tax is paid to said City of Miami Beach. (e) All the terms and provisions of this Act shall not be construed in limitation of, but in addition to any and all other taxes and license provisions of the State of Florida, im- posed upon a licensee of the Florida State Racing Commission, and it is hereby declared to be the specific intention of the Legisla- ture in this Act to supersede and override the limitations against municipal corporations as provided for in Section 10, of Chapter 14832, Laws of Florida, Acts of 1931. SECTION 2. All laws and parts of laws in conflict with this Act be and the same are hereby repealed. SECTION 3.
