i4.dEi t:AS, during the year 1925 a building was erected upon
Lots 9 and 10 of Flock 1 of Ocean Beach Subdivision for the erection
of which a permit was issued by the City of Miami Beach; and
Whi4;i S, a recent survey reveals that said building, encroaches
1 slightly upon the alley immediately to the East of and adjacent to
said property, copy of the engineer' s certificate and sketch of survey
being hereto attached; and
W1iLR.EA3, it is the opinion of the City Council ti;at the en-
croachment was unintentional and caused by an error of the contractor,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that so far as said Council has the
power to bind the City of Miami Beach in the premises, no action of
r_ y kind whatsoever shall be taken by said City to require the owners
and successors, heirs or assigns, to move, or remove, the structure,
or structures, on said land by reason of said encroachment.

plat thereof recorded in plat book 2 at page 38 of the public records
of Dade County, Fla. That the corners of this propert has ben marked
a s indicated on the attached plat. That the building located on
the above described property stnads within the title lines thereof
EXCEPT that the balconies encroach on Biscayne Street as shown. AND
ALSO the building proper encroaches on the 20 foot alley to the East
as shown.There are to other encroachments. There are no encroachments
on this property by any other structure.
