Resolution 6051 RESOLUTION NO. 6651
WHEREAS, the City of Miami Beach, Florida, did, on the
22nd day of April, 1943 , lease, demise and let unto the
United States of America, certain premises situated in the
City of Miami Beach, County of Dade and state of Florida, arra
more particularly described as follows :
That certain tract or parcel of
land in the City of Miami Beach,
County of Dade, State of Florida,
known and designated as, "That part
of Surfside Park lying between Seventy-
Second (72nd) Street and Seventy-
Third (73d) Street, extending westwardly
from the western boundary of Collins
Avenue to the eastern bank of the Inland
Waterway, excepting that portion of Hard-
ing Avenue crossing the above described
land, which shall be reserved for the use
of the public as a street," according to
Flat thereof, hereto` attached and by this
reference made a part hereof, together
with all appurtenances thereto, containing
approximately 661,500 square feet,
and
WHEREAS, the possession of said property has been re-delivered
by the United States of America to said City, and
WHER:+AS, said United States of America has preparedand sub-
mitted a form of release which, by its terms, releases and forever
discharges the United States of America, its officers and agents,
of and from all manner of actions, liabilities and claims which
said City might have by reason of any matter arising out of said
lease and the occupation by the United States of America of said
property, and
WHEREAS, the City Council is familiar with the terms of said
form of release so submitted as aforesaid,
NOW, THEREFORE, BE IT RESOLV,R1) BY THE CITY COUNCIL OF THE CITY
OF MIAMI B ACH, that the Mayor and City Clerk be and they are hereby
authorized and directed to execute said release on behalf of, and
in the name of the City of Miami Beach, Florida.
