A RESOLUTION TO ACCEPT THE WORK PERFORMED
BY WM. S.GREEN CO. ,INC. , KIRBY-TUTTLE CO.
INCORPORATED, AND THE MAXWELL COMPANY,I dC. ,
UNDER THEIR CONTRACTS WITH THE CI'T'Y OF
MIAMI BEACH IN CONNECTION WITH THE CONSTRUC-
TION AND FURNISHING OF RECREATIONAL
FACILITIES AT MIAMI BEACH PIER FEDERAL
WORKS AGENCY PROJECT FLA. 3-246 (N.F. )
AND AUTHORIZING FINAL PAYMENTS DUE SAID
CONTRACTORS UNDER CONDITIONS SET FORTH
HEREIN.
WHEREAS, August Geiger, Architect, has filed with the City
Manager of the City of Miami Beach a report showing the satis-
factory completion of the work under contract between the City
of Miami Beach and Wm. S.Green Co. ,Inc. , dated April 3, 1943,
designated as Contract #1, stating that the work of constructing
the Recreational Facilities at the Miami Beach Pier has been
satisfactorily performed by the said Contractor in accordance
with the plans, specifications and approved change orders,
subject, however, to the terms of the Contract Bond furnished
by the Contractor, and
WHEREAS, August Geiger, Architect, has filed with the City
Manager of the City of Miami Beach a report showing the satis-
factory completion of the work under contract between the City
of Miami Beach and Kirby-Tuttle Co. , Incorporated, dated April
28, 1943, designated as Contract "A", stating that the work of
furnishing electrical equipment at Miami Beach Pier has been
satisfactorily performed by the said Contractor in accordance with
the specifications and approved change orders, subject, however,
to the . terms of the Contract Bond furnished by the Contractor,
and
WHEREAS, August Geiger, Architect, has filed with the City
Manager of the City of Miami Beach a report showing the satisfactory
completion of the work under contract between the City of Ml_ami
Beach and The Maxwell Comranr, Inc . , dated April 29, 1943,
designated as Contract "B", stating the work of furnishing furn-
iture and draperies at the Miami Beach Pier has been satisfactorily
performed by the said Contractor in accordance with the plans
and specifications and approved change - orders, subject, however,
to the terms of the Contract Bond furnished by the Contractor, and
WHEREAS the aforesaid architect recommends that, inasmuch
as the work performed by these contractors had been done in
accordance with the plans, specifications and approved change
orders, it should be accepted.
NOW, THEREFORE, BE IT RESOLVED b? The City Council of the
City of Miami Beach, Florida,
Section 1-A - That the aforesaid work performed by
Wm. S .Green Co. ,Inc. , under its contract
with the City of Miami_ Beach, is hereby
accepted by the City of Miami Beach
subject to the terms of the Contract Bond
furnished by the same contractor through
the Seaboard Surety Company of New York •
as provided for in this specification.
(b) T'nat the aforesaid work performed by Kirby-
Tuttle Co . , Incorporated, under its con-
tract with the City of Miami Beach, is
hereby accepted by the City of Miami Beach
subject to the terms of the Contract Bond
furnished by the same contractor through
the United States FI.delity and Guarantee
Company as provided for in this specification.
(c) That the aforesaid work performed by
The Maxwell Company, Inc. , under its contract
with the City of Miami Beach, is hereby
accepted by the City of Miami Beach, subject
to the terms of the Contract Bond furnished
by the same contractor through the Globe
Indemnity Company as provided for in this
specification.
Section 2 That the City Manager is authorized to pay
to the above contractors the following
amounts which are on their contracts
upon satisfactory proof that the said
contractors have paid all legitimate claims
for labor and materials employed on tie

Section 3 That the work on the project as a whole is
hereby declared fully completed and accepted
by the City of Miami Beach.
