Resolution 5731 RESOLUTION NO. 5731
WHEREAS, certain buildings have heretofore been erected
under permits issued by the City of vliami Beach upon
Lots 1 and 2, Block 38, COMMERCIAL
SUBDIVISION, according to the Plat
thereof, recorded in Plat Book 6,
at page 5, of the Public Records of
Dade County, Florida;
and
WHEREAS, a recent survey reveals that the building located
on Lot 1 encroaches upon the alley, lying North of said Lot 1,
0.7 feet , and encroaches upon Lenox Avenue, lying West of said
Lot 1, 1.7 feet, and encroaches upon Lincoln Road, lying South of
said Lot 1, 1.7 feet ; that the building located on Lot 2 encroaches
on Lincoln Road, lying South of said Lot 2, 1.02 feet, and that the
tile roof eave of said building located on said Lot 2 encroaches
on Lincoln Road lying South of said building 2.0 feet, copy of
the engineer's certificate and sketch of survey being hereto at-
tached; and
WHEREAS, it is the opinion of the City Council that the en-
croachment was unintentional,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Miami Beach, Florida, that so far as said Council has the power
to bind the City of Miami Beach in the premises, no action of any
kind whatsoever shall be taken by said City to require the owners
of said property, their heirs, successors or assigns, to move
or remove the structure or structures located on said land by rea-
son of said encroachments.
